1. The subject-matter of the contract is the comprehensive supply of electricity together with distribution services for the needs of the Municipal Plant in Kostrzyn for a period of 12 months to the facilities listed in Annex 4 to the SWZ â a detailed description of the subject-matter of the contract (list of electricity consumption points). 2. The detailed scope of the contract is specified in Annex 4 to the SWZ (description of the subject of the contract, including the names and locations of the facilities, forecasted demand for electricity during the term of the contract, types of tariffs, contractual capacity, place of delivery and the necessary data to conclude the contract). Other conditions relating to the performance of the contract are set out in the draft contractual provisions â Annex 2 to the SWZ. 3. Comprehensive supply of electricity will take place under the conditions set out in the provisions of the Energy Law Act of 10 April 1997, the Capacity Market Act of 8 December 2017 and in accordance with the implementing provisions issued to those acts, in particular the customer service quality standards set out in the Regulation of the Minister for Climate and the Environment of 29 November 2022 on detailed rules for shaping, calculating tariffs and billing in electricity trade and the Regulation of the Minister for Climate and the Environment of 11 November 2020 on detailed conditions for the operation of the electricity system. The above provisions concern the method of calculation, settlement and quality parameters of supplied electricity. 4. The Contractor is obliged to have contracts with the Distribution System Operator (DSO), i.e. ENEA OPERATOR Sp. z o.o. operating in the territory of the Contracting Authority, enabling the conclusion of effective contracts and the comprehensive delivery and provision of electricity distribution services via the DSO distribution network to electricity consumption points, as defined in Annex No. 4 to the SWZ. ATTENTION! The Contracting Authority reserves that the above-mentioned agreements with the DSO Distribution System Operator shall be held by the Contractor on the day of submission of tenders or at the latest on the day of commencement of comprehensive delivery and provision of electricity services. 5. The Ordering Party informs that it has comprehensive contracts for the sale of electricity for PPE points listed in Annex No. 4 to the SWZ. Currently, the sale of electricity for the needs of the Ordering Party is carried out on the basis of comprehensive agreements (sale and distribution) with ENEA S. A., ul. Pastelowa 8, 60-198 PoznaĆ in force until 31.12.2024. 6. The contracts currently in force will expire on 31.12.2024 and do not require termination by the contractor. 7. The reserve supplier for all electricity consumption points covered by this proceeding is ENEA S.A. with its registered office in PoznaĆ, ul. Pastelowa 8, 60-198 PoznaĆ. 8. The Ordering Party shall provide the Contractor selected in this procedure with the necessary data and documents to carry out the procedure of changing the seller (if necessary), immediately after signing the contract.
