Description

3.1. The subject of the contract is the collection and management in the period from the signing of the contract, but not earlier than from 01.01.2026 to 31.12.2026 of municipal waste indicated in the Description of the subject of the contract from the owners of real estate on which residents live from the Radłów Commune and from the Selective Municipal Waste Collection Point in Radłów, in a way that ensures that appropriate levels of recycling, preparation for re-use and recovery by other methods are achieved and that the levels of mass of biodegradable municipal waste transferred to landfill are reduced in accordance with the applicable regulations. The performance of the subject-matter of the contract must also comply with the provisions of the Waste Act of 14 December 2012 (Journal of Laws No. Journal of Laws 2023, item 1587 as amended), the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (consolidated text: Dz. Journal of Laws of 2025, item 733), the provisions of the current Provincial Waste Management Plan, and the provisions of the Regulations for maintaining cleanliness and order in the Radłów Commune, as well as other provisions of generally applicable and local law – in the current version as at the date of the order. 3.2. A detailed description of the subject-matter of the contract is set out in the Description of the subject-matter of the contract – Annex 1 to the FTZ and in the Draft provisions of the contract – Annex 3 to the FTZ. 3.3. The amount of waste specified in the Offer Form is the maximum amount (i.e. 2 800 Mg). The Ordering Party reserves the right to reduce the scope of the executed order, which is tantamount to incomplete use of the quantity resulting from the Offer Form. The actual amount of waste to be collected may differ from the given amount and will depend on the actual demand of the Ordering Party. However, the minimum scope of the contract performed by the Contractor will not be less than 80% of the maximum total amount of waste provided for in the Tender Form. 3.4. Order with option right: 3.4.1. The scope of the basic order is the amount of waste in Mg/year specified in the Offer Form (i.e. 2 800 Mg). The Ordering Party provides for the possibility of exercising the right of option to a maximum of 10% increase in the collection and management of the amount of waste specified in the Offer Form. 3.4.2. The right to exercise the right of option will be related to the Ordering Party's current needs regarding the need to collect and manage more waste than the amount of waste provided for in the Offer Form, resulting from the amount of waste generated. 3.4.3. In order to activate the option, the Ordering Party shall provide the Contractor, in writing, with a statement expressing its willingness to exercise the right of option and specifying the extent to which it exercises the right of option. The declaration will be submitted no later than 14 days before the date of performance of the service covered by the option right. If the right of option is exercised, the Ordering Party shall provide the Contractor with the declaration referred to in the first sentence at the latest 30 days before the end of the performance of the contract covering the basic scope of the contract. 3.4.4. In the scope of the optional order, the Contractor is obliged to start providing the service on the basis of a written statement of the Ordering Party about exercising the right of option. 3.4.5. The exercise of the right of option by the Ordering Party may be made once for the entire value of the optional order or in several parts. If the option is exercised in several parts, the Ordering Party shall submit further declarations to the Contractor no later than before the moment of exhaustion of the maximum scope resulting from the option right. 3.4.6. The Ordering Party reserves that the contract covered by the option right will be executed on the terms of the basic contract, in accordance with the provisions of this FTZ together with the annexes and the Contractor's offer. 3.4.7. If the Employer exercises the right of option, the Contractor shall be entitled to remuneration for the actual amounts of collected and managed municipal waste. The Contractor's remuneration for the provision of the service covered by the option right will be calculated on the terms provided for in the contract and on the basis of the unit price indicated by the Contractor in the tender. 3.4.8. The right of option is a unilateral right of the Ordering Party, which it may, but is not obliged to, use as part of the performance of the subject of the contract. If the Employer does not exercise the right of option, the Contractor shall not be entitled to any claims in this respect. 3.4.9. The exercise of the option right by the Ordering Party does not require the preparation of an annex to the contract.
