1. The subject of negotiations will be the conditions for the implementation of the contract described below and the price for the collection and management of 1 Mg of waste with code 20 01 10 and 20 01 11 (clothing and textiles). 2. The contracting authority, in an open tender for the collection and management of the above-mentioned waste (reference No ZGOK/PN/20/2022), provided for the possibility of awarding the contracts referred to in Article 214(1) of the GATT 1994. 1 point 7 of the Public Procurement Act to the value of: PLN 200,000.00 net, which amounted to EUR 44,907.49 (at the date of estimating the value of the contract at the euro exchange rate of 4.4536). The amount of waste intended for collection and management under this contract conducted in a single-source mode has been estimated to 100 Mg (basic contract), while under this contract, the Contracting Authority allows the use of the option referred to in Art. 1 of the Public Procurement Act. The Customer may use the option in whole or in part, at one time or in several parts. An option is foreseen to increase the amount of waste to be received and handled with codes 20 01 10 and 20 01 11 in addition to 250 Mg. The Ordering Party will exercise the right of option if there is a demand for further implementation of the above-mentioned services. The maximum possible scope of the contract in the case of using the option by the Ordering Party is up to 350 Mg, including: 100 Mg under the basic order and up to 250 Mg under the option. Since within the scope of this contract the Ordering Party may not exceed the net value of PLN 200,000.00, the final quantity will be determined after negotiating the unit price for the collection and management of waste with codes 20 01 10 and 20 01 11. 5. The Contractor shall collect the above-mentioned waste from the Contracting Authority from the following installations: Municipal Waste Disposal Plant, ul. Lubelska 53, 10-410 Olsztyn. 6. In view of the subject-matter of the contract, the contract must be performed in accordance, in particular, with the following provisions: 1) the Act of 14 December 2012 on waste, 2) the Act of 27 April 2001 Environmental Protection Law, 3) the Act of 13 September 1996 on maintaining cleanliness and order in municipalities and other laws and regulations applicable to the subject of the contract. 7. Waste collected from the Ordering Party will be transferred to the entity holding the decision referred to in Art. 2 point 1 or 2 of the Act of 14 December 2012 on waste indicated by the Contractor before signing the contract. 8. For settlements between the Parties, the amount of waste collected will be determined according to the measurement on the Ordering Party's electronic car scale. 9. The transfer of waste will be confirmed by a waste transfer card â in accordance with the applicable legislation.
