Description

Together with RMV Rhein-Main-Verkehrsverbund GmbH, Verkehrsverbund Rhein-Neckar GmbH intends to award a public service contract for the procurement and ordering of regional bus lines in the Odenwaldkreis and Darmstadt-Dieburg districts on the 13th anniversary of the start of operation. 1 December 2026 pursuant to Article 5(1) of Regulation (EC) No 1370/2007 in conjunction with Section 119(3) of the GWB. On the basis of the current local transport plans of the Kreis Bergstraße, the Odenwaldkreis and the Kreis Darmstadt-Dieburg, the award will be given for the provision of scheduled services to be licensed in the form of regular bus services. The Odenwald-Nord line bundle comprises the lines: - Line 664 Bensheim - Reichenbach - Beedenkirchen - Brandau - Gadernheim (only during school hours) - Line 665 Bensheim - Reichenbach - Gadernheim - Lindenfels (– Reichelsheim) - Line 666 Fürth - Schlierbach - Lindenfels - Winterkasten - Line 667 Balkhausen - Auerbach Fürstenlager - Bensheim - Reichenbach Felsenmeer (seasonal traffic at weekends) - Line 668 Fürth - Schlierbach - Seidenbuch - Gadernheim - Line 696 Gadernheim - Lindenfels - Fürth - Rimbach - Mörlenbach (only during school hours) The tenderer's offer must cover the transport services covered by the transport area, in accordance with the fourth sentence of Paragraph 8a(2) in conjunction with the second sentence of Paragraph 13(2a) of the PBefG and will be assessed on the basis of the overall performance. (Type and quantity of services or indication of needs and requirements) The following rules on tariff compliance and social standards are part of the sufficient transport service to ensure the quality of operation: Due to the labour market situation in the Rhine-Neckar metropolitan region and Bergstraße district, the future operator is obliged to pay its employees at least the remuneration specified in the collective agreements listed below as representative in accordance with the HVTG in order to ensure a sufficient qualification of the driving staff in the performance of the service and to guarantee the working conditions specified in these collective agreements: - collective bargaining agreement for the gew. Employees of the Priv. Passenger transport by bus and coach in Hesse valid from 01.04.19 (M-TV) - collective wage agreement for the employees of priv. Passenger transport by bus and coach in Hesse valid from 01.04.19 (E-TV) The special regulations for urban transport in § 7 A II. M-TV, § 3 E-TV and the General Annex to § 3 E-TV shall apply. Further specifications can be found at http://www.had.de/vergabestellen-tarifvertraege.html. This obligation applies dynamically for the entire duration of the new contract period, i.e. always with regard to the adjustments to the collective agreements still to be made in the future. If subcontractors are used, they must also guarantee compliance with these obligations. In addition to the social standards to be guaranteed by collective agreements, the following conditions for driving time interruptions and breaks apply to all drivers employed: Breaks in driving time and breaks not considered to be working time under collective agreements may not exceed 60 minutes per shift. If the breaks in driving time and breaks exceed this limit, the breaks in working time exceeding 60 minutes shall be attributed to the working time. A real, non-remunerated free time in the sense of a shared service includes a one-time break from work per shift of at least 2 hours, which begins and ends at the employee's place of residence (district) or at a company location with adequate social spaces. The provision of social spaces is not relevant in this context, provided that the interruption of work lasts longer than 4 hours. The following regulations for the transfer of personnel are also part of the sufficient traffic service to ensure the operational quality: Tenderers undertake, in the context of their tender, to offer an employment contract to those drivers who, during the contract award, are employed in the operation of the old operator of the line bundle with at least 70% of the regular working time and who have a valid employment contract with the old operator at the time of commissioning. The new employment contract must be concluded indefinitely and without a probationary period. The recruitment offer must be based on the collective bargaining conditions applicable to the rest of the workforce in the concessionaire's company and laid down in works agreements. Insofar as the collective agreement applied in the acquiring undertaking determines the amount of remuneration and the number of days of leave depending on the length of service, the new employment agreement must provide that service with the old operator is to be regarded as a service with the acquiring undertaking in the context of remunerated grouping and leave.
