Poland-Gdansk: Training services
1. The subject-matter of the contract is the provision of courses on a category driving licence. B together with the examinations for participants in the project “New Perspectives 2” co-financed by the European Union under the European Social Fund (Human Capital Operational Programme Priority 1, Measure 1.3, Sub-measure 1.3.3) implemented by the Pomorskie Voivodeship Regional Headquarters.
2. The subject matter of the contract is divided into 4 tasks.
A. Task No 1 – Gdynia 34 participants aged 18-25
B. Task 2 – Słupsk 22 participants aged 18-25
C. Task 3 – Those 8 participants aged 18-25
D. Task 4 – Preliminary 8 participants aged 18-25
3. The courses will be carried out for participants from the Pomorskie/Pomorskie Voivodship Labour Headquarters:

4. Theoretical and practical classes must be carried out in localities:
A. Task No 1- Gdynia 34 participants aged 18-25
B. Task No 2- Słupsk 22 participants aged 18-25
C. Task 3- Byte 8 participants aged 18-25
D. Task 4- Cheese 8 participants aged 18-25
5. Driving licence courses will be provided for 60 hours per person (including 30 hours of theoretical instruction and 30 hours of practical instruction). Theoretical classes may not be provided in the form of e-learning.
6. At the end of the courses, participants will take the state external examinations conducted by the Provincial Road Traffic Centres. The contractor will pay three samples of State tests for each participant (1 theoretical test and depending on the result obtained successive theoretical or practical examinations – up to 3 in total).
7. When calculating the tender, the contractor must include 3 State exams in its tender.
8. The Contractor shall bear all costs relating to the organisation and delivery of the course, in particular:
A. the cost of the trainer’s remuneration,
B. The cost of the theoretical classroom,
C. cost of teaching materials,
D. cost of medical examinations entitling each participant to take part in a cat driving licence course. B
E. delivery of a Cat driving licence course. B in accordance with the legislation in force and all the costs of taking the three State examinations carried out by the Voivodship Road Traffic Centres,
F. the cost of travelling to the WORD for the tests.
9. The Contractor shall provide each trainee free of charge with the teaching and support materials necessary for the course:
A. handbook with a multimedia board and self-tuition tests at home
B. booklet (notebook)
C. stationery (long and pencil)
10. If medical contraindications to attend a driving licence course are found, the participant in the course will be removed from the list of participants and the Contractor will not receive any remuneration per participant.
11. Admission to the classes will be based on personal lists of persons issued by the Contracting Authority.
12. The activities will take place from Monday to Friday. Due to the large number of other training courses, the project can take place both in the morning and in the afternoon. The exact dates and times of the activities will be agreed with the local coordinators. At the request of the local coordinator, activities may also be held on Saturdays, Sundays and public holidays.
13. If the classes are not carried out for reasons beyond the control of the Contracting Authority, the outstanding classes will be carried out within a mutually agreed time limit, but no later than 5 days from the date of the courses which did not take place.
14. The Contractor shall ensure that the instructors have due competence, authority, apprenticeship and exercise due diligence to perform the subject of the contract in accordance with the applicable law.
15.The driving licence must be completed by 31/05/2014. Three samples of state tests must take place by 15/06/2014.
16. The contractor shall ensure ongoing substantive supervision of the performance of the subject-matter of the contract.
17. The Contractor shall be responsible for the quality and diligence of the performance of the services offered and shall be fully liable for damage caused by non-performance or improper performance of the contract.
18. The Contractor shall, at the reasoned request of the Contracting Authority, replace the existing instructor with another instructor guaranteeing the proper and timely performance of the classes.
19. The person performing the contract on behalf of the Contractor may be changed during the performance of the contract only with the Contracting Authority’s written consent.
20. The Contractor may not entrust the performance of the subject-matter of the contract to a third party without the Contracting Authority’s written consent. The rights and obligations arising from this contract and other arrangements between the parties may not be transferred to third parties without the prior consent of the Contracting Authority.
21. The Contractor may subcontract part or all of this contract. In this case, it shall indicate in the tender form the proportion of the contract which it intends to subcontract.
22. The Contractor declares that he will not infringe copyright and other property rights of third parties and that, should such an infringement occur, the Contractor shall assume the responsibility of the Contracting Authority.
23. The Contractor may remove a person from the list of participants for not attending courses only at the request of the Contracting Authority.
24. The contractor undertakes to:
A. Training record keeping.
B. Monitoring the attendance of participants and informing the Contracting Authority in writing of the repeated absences of each participant in the event of exceeding 10 % of absences. If the Contractor fails to notify the above – when the participant’s absence exceeds 20 % – he/she may be removed from the list of project participants and the Contracting Authority may refuse to pay for his participation in the training.
C. Ensure proper promotion of activities, specifying the name of the contracting authority and the name of the project, and informing them that they are co-financed by the European Union under the European Social Fund. All materials and documents must bear the appropriate logo of the European Union – the European Social Fund and the Human Capital – National Cohesion Strategy, in accordance with Council Regulation (EC) No 1083/2006 of 11 July 2006 and the Guidelines for the identification of projects under the Human Capital Operational Programme.
25. The contractor must act in accordance with the Personal Data Protection Act (Journal Journal of Laws 2002, No 101, item 926, codified text).
26. The Contractor is obliged to sign the contract entrusting the processing of personal data, if no objection is raised by the Second Level Intermediate Body, the Human Resources Development Centre. Under the contract entrusting the processing of personal data, the Provincial Governor of Pomorskie Province of the VLC authorises the Contractor to issue personal data authorisations to its staff to process participants’ personal data. The authorised Contractor will limit access to the personal data of the project beneficiaries only to staff authorised to process personal data. The Contractor will keep records of the above-mentioned staff and shall be obliged to provide the Contracting Authority with certified copies of the authorisations issued without delay and no later than 7 days after the date of conclusion of the contract entrusting the processing of personal data.
27. The subject-matter of the contract will be received by service acceptance protocols signed by the local coordinators. The service acceptance report is the basis for the invoice/account.
28.The Contractor must issue VAT/invoices to the Contracting Authority and deliver to the Contracting Authority by 15 June 2014 at the latest.
29. The Contractor must attach the following documents to the invoice/account:
A. Service acceptance protocols signed by the local coordinators;
B. photocopies of the seizures carried out;
C. The theoretical and practical internal examination confirmation sheets;
D. Confirmation of completion of the fee for the 3 State examinations of each participant;
E. List of participants, including a copy of the dates and results of the national theoretical and practical exams of each participant;
F. Original lists of participants, together with their signatures, confirming receipt of specified teaching and support materials;
G. Bulletin of activities
H. 2 photos of the activities carried out in paper format.
Photocopies of the documents transmitted must be certified as true copies on each page.
30. The payment will be made on the basis of an invoice/account issued by the Contractor once the Contracting Authority has received funds from the higher-ranking unit of the Head Office of the Voluntary Labour Board in Warsaw for the financing of the ‘New Perspectives 2’ project implemented under Priority 1, Measure 1.3, Sub-measure 1.3.3 of the Human Capital Operational Programme.
31. Payment will be made by transfer to the Contractor’s bank account indicated in the VAT invoice/account within 30 days of receipt of the correctly issued VAT invoice/account, 85 % of the value of the contract being paid from the bank account of the Ministry of Finance implemented by Bank Gospodarstwa Krajowego (EU Funds) and the remaining 15 % from the Contracting Authority’s bank account (special reserve of the State budget). The funds for the settlement of financial obligations are secured from the special-purpose reserve of the budget of European funds and the State budget. In view of possible delays in the transfer of funds from the special-purpose reserve of European funds and the special-purpose reserve of the State budget, payment may be made at a later date, but not exceeding 30 days from the date on which the funds were put at the disposal of the Contracting Authority.
32. Persons performing tasks personally, e.g. under a civil-law contract or natural persons carrying out a business:
A. They must fill in a declaration by which the contractor employed in more than one project undertakes to keep and transfer monthly records of the hours and tasks performed in all NSRF projects in which it is involved during the implementation period of the New Perspectives 2 project tasks. These records should be a person’s ‘job diary’, from which it should be stated what tasks under which contract and during which hours the person performed each day (Record of tasks carried out under NSRF projects)
B. the resulting burden shall not preclude the proper and efficient execution of all the tasks assigned to the person concerned and the total commitment to the project tasks shall not exceed 240 hours per month.
33. The Contracting Authority reserves the right of option, i.e. the possibility of reducing the number of individuals per course compared to those indicated in the price form. The maximum scope of the contract may be reduced by no more than 10 % of the total value, i.e. at least 90 % of the value of the contract.
