1. The subject of the contract is: Delivery of a device for scanning textile tapes as part of the project entitled ‘Public Security Technology Centre’ No FEDS.01.01-IZ.00-0003/24. The subject of the contract includes the delivery of the device, assembly, installation, commissioning and instruction (online, in Polish or English, for at least 4 people) and checking the correctness of operation at the place designated by the Ordering Party at the seat of the Ordering Party. CPV code: 38500000-0 Control and research equipment All costs related to the performance of the subject of the contract, including delivery, insurance, risk, commissioning shall be borne by the Contractor. 2. Place of delivery: Wrocław University of Technology, ul. na Grobli 15, 50-421 Wrocław, building L-1, 046. 3. A detailed description of the subject-matter of the contract can be found in Annex 2 to the FTZ-OPZ. 4. The detailed scope of performance of the subject-matter of the contract, which is the draft provisions of the public procurement contract, is contained in the model contract, constituting Annex 3 to the FTZ. 7. In accordance with Article 257 of the Public Procurement Law, the contracting authority provides for the possibility of cancelling the procedure in question if the funds which the contracting authority intended to allocate to finance all or part of the contract have not been allocated to it. 8. The contracting authority provides for the use of the so-called reverse procedure referred to in Article 139(1) of the Public Procurement Law, i.e. The contracting authority will first examine and evaluate the tenders, and then make a qualitative selection of the Contractor whose tender was the highest rated, in terms of the absence of grounds for exclusion and compliance with the conditions for participation in the procedure. 9. The Contractor shall be bound by the tender from the closing date for the submission of tenders to 05.02.2026r (90 days). 10. The tender must consist of: 10.1.the Contractor's offer form – an interactive form available on the e-Procurement Platform, indicating in particular the offer price for the entire subject of the contract; 10.2. the statement referred to in section VII point 1 SWZ - JEDZ - an interactive form available on the e-Procurement Platform; 10.3.declaration referred to in section VII point 1a of the FTZ - (respectively) Declarations Nos 5.1 and 5.2 to the FTZ; 10.4.(if applicable) the commitment of the provider referred to in section point 6 of point VII of the FTZ; 10.5.(if applicable) the demonstration of the reservation of information constituting a trade secret in accordance with X point 6; 10.6.document(s) from which the right to sign the Offer arises in accordance with section X point 15 of the FTZ; (if applicable) the relevant powers of attorney in accordance with Chapter X point 16 of the FTZ; 10.7.(if applicable) Statement of contractors jointly applying for the contract - in accordance with Article 117(4) of the Public Procurement Act 10.8.PREVIOUS EVIDENCE MEANS confirming that the deliveries offered by the Contractor meet the requirements specified by the Ordering Party, features: description of the offered subject-matter of the contract - technical specification of the offered subject-matter of the contract together with possible Information for Contractors - allowing to determine the conformity of the offered device/set with the requirements of the Ordering Party presented in Annex 2 to the FTZ, respectively - completed Annex 2 to the FTZ. The Contracting Authority considers the means of proof indicated by the Contractor in Annex 2 to the FTZ OPZ col. Parameters offered – confirmation of compliance with the requirements through the parameters offered by the Contractor. In accordance with Article 107 of the Public Procurement Act, if the Contractor has not submitted the evidence in question or the evidence in question is incomplete, the Contracting Authority will call for it to be submitted or supplemented within the prescribed period (current on the date of its submission). This rule shall not apply if, despite the submission of the measure of inquiry in question, the tender is rejected or there are grounds for invalidating the procedure. 11.The Contractor is obliged to attach to the Tender a statement valid at the date of submission of tenders that it is not subject to exclusion and meets the conditions for participation in the procedure - the Contractor submits it in the form of a Single European Procurement Document, hereinafter referred to as the SED, constituting Annex 2 to Commission Implementing Regulation (EU) 2016/7 of 5 January 2016. 11a. The SEDZ does not cover the grounds for exclusion referred to in Article 5k of Regulation 833/2014 as amended by Regulation 2022/576. Therefore, the Contractor shall attach to the Tender a declaration separate from those submitted on the EEDZ form (consistent with Annex II). No 5.1 to the FTZ for the Contractor/Contractor jointly applying for the contract and Annex No 5.2 to the FTZ for the entity making the resources available). 11.3. If the Contractors jointly apply for the contract, the EED shall be submitted by each of the Contractors applying for the contract. 11.4. The contractor, in case of reliance on the capacities or situation of the providers of resources, shall also submit the provider of resources together with its SED2. If it concerns the Contractor, it relies on the resources of entities making resources available, as referred to in Article 118(1) of the Public Procurement Law Act, it submits, together with the tender, a commitment of the entity making resources available – details of Chapter VIII of the FTZ
