United Kingdom-Telford: Military vehicles and associated parts
Military vehicles and associated parts. Babcock DSG Limited, acting as a Procurement Agent on behalf of the UK Ministry of Defence (MoD), proposes to let a contract with Polaris Britain Limited for the supply of spares over a 4 year period.
It is considered that this contract can be placed using the Negotiated Procedure Without Prior Publication pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii)(aa) of the Defence and Security Public Contracts Regulations 2011) for technical reasons because Polaris Britain Limited has exclusive rights to the range of items in scope of this requirement. The MOD does not have a licence to use the exclusive rights, being copyright in design and drawings, which would enable it to seek competitive bids, and nor have the exclusive rights been licenced to another provider and no third party, including the MOD, has been granted a licence to use these exclusive rights. There is no available and lawful equivalent that another supplier could offer to satisfy the requirement.
