Description

The subject of the contract is the successive delivery of poultry meat and poultry meat sausages to the warehouses of the 33rd Military Economic Branch located in the following locations: Nowa Dęba, ul. Anieli Krzywoń 1, Kielce, ul. Polish Army 300, Sandomierz, ul. Adam Mickiewicz 38. A detailed description of the subject-matter of the contract, for each product item, is set out in the annex to the FTZ — Minimum quality requirements. The detailed specification of the quantity of the individual assortment being the subject of the contract carried out under the basic contract and the contract carried out under the option right are set out in the annexes to the FTZ, i.e. Detailed valuation forms – separately for each lot of this contract. Taking into account the nature of the subject of the contract, the contracting authority does not provide for the inclusion of accessibility requirements for disabled persons in accordance with Art. 1 of the Public Procurement Law Act of 11 September 2019. The draft provisions of the public procurement contract are presented in the annex to this FTZ (one draft contract for all parts of the procedure) and supplement the description of the subject-matter of the contract in terms of provisions not regulated by this Chapter. The production of the subject of the contract, the method of its packaging and transport must meet the requirements of applicable national and EU food law. These provisions are set out in the Annex to the FTZ – draft agreement. Contractors, as food business operators operating food or catering establishments, are required to ensure food safety in accordance with the principles of the Hazard Analysis and Critical Control Points System, called the ‘HACCP system’ (proceedings aimed at ensuring food safety by identifying and estimating hazards from the point of view of food health requirements and the risk of hazards occurring during the course of all stages of production and marketing of food, this system also aims to define methods for eliminating or reducing hazards and to determine corrective actions). In view of the above, the Contractor applying for the award of the contract must have the following up-to-date documents (including for the duration of the contract) which will show, at the request of the Contracting Authority: confirmation of the implemented HACCP system in the form of a HACCP certificate issued by companies accredited and authorised by the Polish Centre for Accreditation with its registered office in Warsaw or a national accreditation organisation for a given country or a certificate from the competent body of the State Sanitary Inspectorate or the body of the Veterinary Inspectorate on supervising the application of the implemented HACCP system confirming compliance with the requirements necessary to ensure hygiene in the production process or trade in the items subject to the contract and to ensure the proper quality of those articles. The contracting authority shall allow partial tenders to be submitted. A tender may be submitted for one, two or all parts of the procedure. The contracting authority in these proceedings does not request the submission of the evidence referred to in Articles 104 to 107 of the Act of 11 September 2019. – Public Procurement Law. The parties to the future contract agree that the performance of the contract will start no earlier than 1 January 2026 and will last until 31 December 2026 or until the amount constituting the maximum remuneration due to the Contractor for the performance of the contract has been exhausted, in accordance with the content of the tender submitted by the Contractor. The delivery of the products subject to these proceedings will take place a maximum of 6 times a week. The Contracting Authority reserves the right to make changes to the scope specified in the draft contract, which is an annex to the FTZ, but only to the extent that it does not change the essential conditions of the submitted tender and the FTZ. The Contractor will be bound by the submitted tender for a period of 90 days, i.e. until 10 January 2026. The tender, under pain of nullity, shall be drawn up in Polish in electronic form, i.e. signed with a qualified electronic signature by a person/persons authorised/authorised to represent the Contractor in accordance with statutory requirements or by an appointed representative. The Contractor is obliged to secure his offer of a security (for each part separately) in the amount of: Part 1: PLN 20 000.00; Part 2: PLN 5 000.00; Parts 3, 4, 5 and 6: in the scope of parts 3, 4, 5 and 6 of these proceedings, the Ordering Party does not require the security offer to be secured. The contracting authority in these proceedings does not require the provision of a security for the proper performance of the contract. The contracting authority provides for the possibility of cancelling the procedure in question on the basis of Article 310(1) of the Public Procurement Act, i.e. if the funds which the contracting authority intended to allocate to finance all or part of the contract have not been granted to it. The offer consists of: Tender Form and Detailed Valuation Form (according to the part requested by the Contractor) – completed and signed by qualified electronic signature by persons authorised to represent the Contractor, drawn up in accordance with the model annexed to the FTZ.
