Description

In so far as, by 1 May 2026, no carrier has commenced or can demonstrate that it is about to commence scheduled air services between Tarbes-Lourdes airport and Paris-Orly airport in accordance with the public service obligations imposed on that route and without requesting financial compensation, France has decided, pursuant to Article 16(9) and (10) of Regulation (EC) No 1008/2008 of the European Parliament and of the Council of 24 September 2008 on common rules for the operation of air services in the Community, to grant an air carrier, following a call for tenders in accordance with the procedure laid down in Article 17 of that Regulation, the right to operate those air services exclusively from 1 June 2026. The services must be operated in accordance with the public service obligations imposed on this route, as last amended by order of 12 September 2025 published in the Official Journal of the French Republic of 19 September 2025. In addition to the revenue collected directly from its customers, the selected carrier will receive compensation from delegating public persons corresponding to the difference between the actual expenditure excluding taxes (VAT and taxes specific to air transport) for operating the service and the commercial revenue excluding taxes (VAT and taxes specific to air transport) provided by the latter, within the limit of the maximum compensation to which the delegatee has committed, less any reductions applied under the conditions laid down in the Public Service Delegation Agreement.
