Description

The standstill clause “The entry into force of this Works Contract is subject to this standstill clause, in the sense that its signature is subject to the signature of the Financing Contract for the Project “Development of Water and Wastewater Infrastructure in Harghita County”, under the Sustainable Development Programme 2021-2027 (SDP), to be concluded between S.C. HARVIZ S.A. (beneficiary of the financing) and the Ministry of European Funds, from which the need for the services covered by this Contract derives directly. The Contract of Works will be signed within a maximum of 6 months (term estimated by S.C. HARVIZ S.A. for obtaining the financing) from the date when the successful bidder is entitled to sign the Service Contract, respectively during the period of validity of the tenders and the participation guarantee. In the event that, for whatever reasons, the Financing Agreement related to the Project carried out by S.C. HARVIZ S.A. is not signed within the above deadline, the Beneficiary reserves the right not to conclude the Works Contract, and the Contractor understands that the Beneficiary cannot be held liable for any damage arising in the event of non-conclusion of the Works Contract, regardless of its nature and regardless of whether the Beneficiary has been notified of the existence of such damage. The entrepreneur accepts this standstill clause, assuming full liability for any damage he may suffer in the situation described. The effects of this suspension clause will cease as soon as the Financing Contract has been concluded with the Ministry of European Funds and the Beneficiary undertakes, within 7 (seven) days of taking possession of that document, to notify the Contractor of the signing of the Works Contract’. The object of the procurement is to award the works contract: CL1 - Extension and rehabilitation of the water supply and sewerage system in Middle Ciuc, including: - Lot 1: Expansion of the water supply and sewerage network in Chisinau municipality Miercurea Ciuc - Lot 2: Extension of the distribution and sewerage network in Csiba, Szeczseny - Lot 3: Extension of water supply and sewerage system in Fitod, Leliceni, Misentea - Lot 4: Extension of water supply and sewerage system in Upper Ciuc The object of the contract includes: a) Construction works; b) Supply and installation of machinery and technological equipment; c) Testing and commissioning; d) Monitoring and providing assistance/consultancy to the responsible personnel during the Warranty Period, when necessary; e) Remedying any defects occurring during the Warranty Period; f) Training of the Beneficiary's personnel. Throughout the warranty period, the Entrepreneur will consider maintaining staff with continuous presence, to monitor the operational performance of the works performed, in order to verify compliance with the maximum ceilings of the operating costs guarantees, providing training and operational assistance to the Beneficiary's staff. The number of days until which interested economic operators can request clarifications before the deadline for submission of tenders is 19 days before the deadline for submission of tenders.
