Description

1. The subject of the contract is the delivery and installation of digital alarm sirens, which will be a key element of the Warning and Alarm System (SOiA). The contract is being implemented as part of the project ‘Extension of the alert and alert system’, which is part of the National Recovery and Resilience Plan (RRP). 2. When calculating the price for the subject of the contract, the Contractor is obliged to take into account all costs related to the performance of the contract in accordance with the RVU, including its annexes containing a description of the subject of the contract, until receipt of the subject of the contract by the Ordering Party without any reservations. 3. The subject of the contract is to be brand new, unused and unexposed at exhibitions or trade fairs, technically efficient, safe, compliant with applicable standards and quality standards, complete and ready for use, and must meet the minimum technical, functional requirements. Requirements for the Contractor related to the performance of the contract: The contractor is responsible for quality, compliance with the technical and quality conditions described for the subject of the contract; Due diligence is required in the performance of obligations under a public procurement contract. 5. The contractor must indicate in the ESPD the parts of the contract which it will entrust to subcontractors.The method of transport and packaging of the equipment must ensure protection against damage. The contract is being implemented as part of the project ‘Expansion of the warning and alert system’, which is part of the National Recovery and Resilience Plan (RRP) of the Ministry of Interior and Administration programme ‘Resilience to crisis – optimisation of the infrastructure of state services responsible for security’. The Contractor undertakes to perform the subject of the contract in accordance with the scope and requirements indicated in the Description of the subject of the contract constituting Annex No. 4 to this SWZ, with applicable regulations and standards, the current level of technical knowledge and the draft provisions of the contract, as well as with due diligence. 11. The Contracting Authority allows the Contractor to perform the contract in question using subcontractors, which it is obliged to indicate in Section D in Part II. of its own single document form (SED) referred to in point 9.2 of the SWZ. 12. The Contractor is bound by the submitted tender from the date of expiry of the deadline for submission of tenders (inclusive) until 15.07.2025, i.e. 90 days. If the selection of the most advantageous tender does not take place before the expiry of the deadline for binding the tender specified in the SWZ, the Ordering Party shall, before the expiry of the deadline for binding the tender, once ask the contractors for consent to extend this deadline by the period indicated by him, not longer than 60 days. Extension of the deadline for binding the offer referred to in par. 2, requires the contractor to submit a written declaration of consent to extend the deadline for binding the offer. 13. The Ordering Party does not require the submission of a deposit 14. The Ordering Party will require before the conclusion of the contract to lodge a performance bond in the amount of 3% of the gross price offered. The content of Articles 449-453 of the Public Procurement Act concerning the performance bond will apply within the framework of the contract concluded with the Contractor of this contract. 15. The Contracting Authority reserves the right to cancel the procedure in the case referred to in Article 257 of the Public Procurement Act, i.e. if the public funds that the Contracting Authority intended to allocate to finance all or part of the contract were not awarded to it 16.
