Poland-Katowice: Furniture (incl. office furniture), furnishings, domestic appliances (excl. lighting) and cleaning products
3.1. The subject-matter of the contract is the supply (including installation) of kitchen furniture to building No 11 situated in Katowice at ul. Ligocka 103, on the basis of a project for interior arrangements drawn up by Mr Tomasz Zarzycki, conducting business activities under the name ART-DESIGN Wykonawstwo Tomasz Zarzycki, with registered office in Rycerce Górna 362, 34-370 Rajcz and described in detail in the design – range of kitchen furniture in accordance with Annex 1 to the ToR.
3.2. The contracting authority indicates that the contractor will also be obliged to deliver and install bathroom accessories to the premises indicated by the Contracting Authority in building No 11 planted in Katowice at ul. Ligocka 103 in accordance with Annex 1 to the ToR.
3.3. The Contractor will be required to:
3.3.1. the supply and installation of furniture, including its setting in the premises indicated by the Contracting Authority, i.e. in kitchenettes;
3.3.2. connection of household appliances (fridges, dishwashers) in kitchenettes;
3.3.3. the supply and installation of bathroom accessories, including their fitting in places designated by the Contracting Authority;
3.3. The Contractor will also be required to:
3.3.1. quality control;
3.3.2. plaster repairs, wall painting in the event of damage during fitting of furniture and bathroom accessories;
3.3.3. order the site and the facility after the works have been carried out.
3.4. The documents constituting the description of the subject-matter of the contract are attached as Annex 1 to the ToR.
3.5. The Contracting Authority also informs that the project documentation referred to in point 3.1 of the ToR are fully protected by the Copyright and Related Rights Act of 4.2.1994 (Journal of Laws 2006, No 90, item. 631 as amended). The designers and the contracting authority shall be exempt from copyright in the design documentation. The contractor is therefore completely prohibited from duplicating, disseminating and any drafting or other use of the project documentation in question, as well as the design and technical information contained therein. These documents may be used by the Contractor only for the purposes of participation in this procedure. In the event of infringement of the above prohibition or any other infringement of copyright, the Contractor shall be required to make good the damage caused to the Contracting Authority or to the designers and to reimburse any benefit which he has obtained from it.
3.6. All dimensions given in the interior arrangements documentation – check on the building with the reality of the elements already carried out.
3.7. Where the name of the manufacturer, trade mark or patent is used in the description of the subject-matter of the contract, the Contracting Authority shall require such indications to be regarded as examples and shall allow materials, equipment, etc. to be used in the performance of the contract with equivalent parameters not lower than those indicated. If the contractor offers materials/equipment equivalent to those proposed by the Contracting Authority in the design documentation, the contractor must attach to the tender:
A summary of the materials/equipment used and an indication of which materials/equipment described in the above-mentioned documents are substituted;
3.7.2. documents proving that the material/equipment it offers meets the equivalence condition;
Declaration of compatibility of the materials/equipment(s) proposed by him or her equivalent to the material/equipment unchanged.
The contracting authority also informs that the contractor offers as equivalent materials/equipment instead of the materials/equipment indicated by the Contracting Authority in the design documentation will be verified by the Contracting Authority. If it is found that the materials/equipment offered by the contractor are not equivalent to those requested by the Contracting Authority, the Contracting Authority will request that the contractor’s tender be amended to enable the condition of equivalence to be met. If the Contracting Authority’s request is not met, the contractor’s tender will be rejected as not corresponding to the content of the ToR.
