The subject-matter of this contract is: 1. Preparation of design and costing documentation and execution of construction works involving the creation of the Staszów Economic Area in Grzybów, in the ‘design and build’ system, including: 1) Stage I – preparation of design and cost documentation, i.e. execution of design works, including the scope of planned construction works, in accordance with the scope of the subject of the contract and described in the functional and utility program, together with obtaining all necessary opinions, arrangements and permits, including notification of the intention to perform construction works or a decision on building permit, if required and the scope of works indicated below, the obligation to obtain a construction permit / notification of the intention to perform construction works regarding the reconstruction and extension of the existing railway siding belonging to Grupa Azoty S.A. in order to ensure access to railway infrastructure to the investment areas of the Staszów Economic Area in Grzybów has been excluded from the scope of this contract. 2) Stage II - execution of construction works resulting from the functional and utility program, in accordance with the design documentation prepared and accepted by the Ordering Party - excluding the reconstruction and extension of the existing railway siding belonging to Grupa Azoty S.A. in order to ensure access of the investment areas of the Staszów Economic Area in Grzybów to the railway infrastructure, and the planned other railway infrastructure, and: a) geodetic service, including the execution of as-built inventory (applies to cases required by law), b) preparation of as-built documentation (which includes, among others, protocols, instructions for operation and maintenance of installed devices, certificates of approval, attestations and DTR of installed devices, information on the guarantee granted, as-built geodetic inventory, instructions for operation of facilities), c) regulation and technological start-up together with the handover of new installations for operation, d) implementation and placement of an information and memorial board about the sources of financing of the task, e) transmission to the Ordering Party of a facility suitable for use along with obtaining for the Ordering Party a relevant final decision on the use permit / notification of the intention to enter into use. 2. Stage I of the subject-matter of the contract shall include, in particular: 1) Acquisition of necessary materials (e.g. maps for design purposes), 2) Execution of surveys, including geotechnical surveys (the Contractor will carry out additional geotechnical surveys for the purpose of investment implementation and other surveys imposed at the stage of arrangements and project evaluation), 3) Preparation of construction and executive designs and technical specifications for the execution and acceptance of works in accordance with the requirements contained in the Regulation of the Minister of Development and Technology of 20 December 2021 on the detailed scope and form of design documentation, technical specifications for the execution and acceptance of construction works and functional and utility program (Journal of Laws No. Laws of 2021 Item 2454). Execution of project and costing documentation (also in electronic version – on a DVD with data carriers in pdf format and formats enabling editing - in the amount of 1 issue), hereinafter referred to as project and costing documentation in the contract, including in particular: a) design documentation (construction project covering all industries) - in the amount of 5 copies in paper form, b) bill of quantities and investor's cost estimate - in the amount of 2 copies each in paper form, c) Technical Specification for the Execution and Acceptance of Works - in the amount of 1 copies in paper form, 4) Reconciliation with the Ordering Party of the final version of the construction project, 5) Obtaining a water permit 6) Obtaining an environmental decision, 7) Obtaining a construction permit and/or notification of works and all necessary: arrangements, opinions, permits and consents resulting from the applicable regulations, 8) Obtaining consents from the owners of plots when, as a result of the design solutions adopted, the investment will extend beyond the Investor's plots and will interfere with private plots – in the case of a construction permit, 9) Preparation and obtaining decisions and provisions necessary to implement the investment under the ZRID procedure: obtaining consent for the implementation of a road investment – Act of 10 April 2003 on special rules for the preparation and implementation of investment projects in the field of public roads (consolidated text: Laws of 2024 Item 311), 10)Preparation of draft divisions of real estate for the purpose of investment implementation on the basis of the ZRID – Act of 10 April 2003 on special rules for the preparation and implementation of investment projects in the field of public roads (consolidated text: Dz.
