Description

Die vorliegende Bekanntmachung dient dem Abschluss von Vereinbarungen mit pharmazeutischen Unternehmen im Sinne von § 130a Abs. 8 Satz 1 SGB V. Die Aufforderung zur Teilnahme ist nur an pharmazeutische Unternehmer oder Arbeitnehmergemeinschaften pharmazeutischer Unternehmer im Sinne des § 4 Abs. 18 Arzneimittelgesetz gerichtet. Es handelt sich nicht um ein Offenes Verfahren nach § 15 VgV i. V. m. § 119 Abs. 3 GWB, sondern um eine Veröffentlichung der Aufforderung zum Abschluss/Beitritt von/ zu Rabattverträgen mit für alle Teilnehmer festgelegten und nicht verhandelbaren Konditionen einschließlich der Höhe des Rabattes. Vertragspartner können unbegrenzt viele pharmazeutische Unternehmer oder Arbeitnehmergemeinschaften pharmazeutischer Unternehmer im Sinne des § 4 Abs. 18 Arzneimittelgesetz werden.
