1. The subject of the contract is the collection and management of municipal waste from owners of residential properties located in the municipality of Kętrzyn. 2. The Contractor bears full responsibility for the management of the collected waste in accordance with the applicable legal provisions, in particular in the field of transhipment of waste, its transport, delivery to an authorized entrepreneur conducting activity in the field of recovery or disposal of municipal waste. 3. The Contractor shall in particular be required to: 1) collection of all collected municipal waste from real estate residing in the Municipality of Kętrzyn, in accordance with the required frequency and according to the schedule; 2) preventing the dumping of waste during loading and transport, weighing all collected municipal waste; 3) maintaining proper sanitary and technical condition of vehicles, devices and containers; vehicles must be protected against the escape of waste during loading, transport, transhipment; vehicles, equipment and containers must be cleansed and disinfected; 4) providing the Ordering Party for each settlement period (month) with written information specifying the mass of collected and managed waste, including: weight of mixed waste, type and weight of fractions of separately collected waste; 5) keeping records of waste, reporting, including providing the Ordering Party with reports of the entity collecting municipal waste from property owners, in accordance with the requirements of the law; the basis for drawing up the reports is the waste register and waste transfer cards kept by the contractor; 6) monitoring the obligation of the property owner regarding the separate collection of municipal waste; if it is found that the owner of the property does not comply with the waste segregation obligation, the Contractor collects the waste as mixed, notifies the Mayor and the owner of the property and prepares information (e.g. a statement, photographic documentation) in order for the Mayor to issue an administrative decision on the change in the amount of the fee; 7) transfer of collected mixed municipal waste to a municipal installation; 8) management of separately collected municipal waste in a waste recovery and disposal facility, in accordance with the waste hierarchy and the principle of proximity referred to in the Act of 14 December 2012 on waste (Journal of Laws No. Journal of Laws 2023, item 1587 as amended); 9) The Contractor shall be obliged to provide the Ordering Party with copies of waste transfer cards to municipal installations or other units for the collection of separately collected waste in accordance with the applicable models referred to in the Regulation of the Minister of the Environment of 25 April 2019 on the templates of documents used for the purpose of waste records (Journal of Laws of 2019, No. Journal of Laws 2019, item 819).
