Description

Acquisition of a "Digital Platform for Fleet Management and Maintenance" The duration of the sectoral supply contract will be 12 months from the date of its signature and will be concluded after the completion of the award procedure of the supply contract under the following condition: SUSPENSIVA CLAUSE - The conclusion of the contract is subject to the signing of the addendum amending financing contract No 45/13.12.2023 on the basis of Note No Sinv/1/174/23.04.2025 approving the proposal for amending financing contract No 45/13.12.2023 for the project for the modernisation of 55 electric locomotives intended for passenger train towing, the conversion of 20 hydraulic diesel locomotives into battery electric locomotives and the modernisation of 139 passenger carriages’, financed by the National Recovery and Resilience Plan Component 4 – Sustainable transport, Annex 1 – Project fiche. If, for whatever reasons, grant contract No 45/13 December 2023 is not amended by an addendum in accordance with Note No Sinv/1/174/23 April 2025 within a maximum period of 60 days from the date of approval of the procedure report, the award procedure will be automatically cancelled in accordance with Article 225(1)(c), sentence II of Law No 99/2016, as amended, making it impossible to conclude the sectoral procurement contract. The tenderers in this procedure understand that SNTFC ‘CFR Călători’ S.A. cannot be held liable for any damage in the event of annulment of the award procedure, regardless of its nature and regardless of whether SNTFC ‘CFR Călători’ S.A. has been notified of the existence of such damage. Tenderers in the procedure accept the use of the above special conditions/standstill clause, assuming full liability for any damage they may suffer in the situation described. The economic operator will be able to request clarifications 18 days before the deadline for submission of tenders and the contracting entity will respond clearly and completely to all requests for clarifications / additional information 11 days before the deadline for submission of tenders.
