1. The subject of the contract is ‘Design and execution of construction works involving demolition, extension, reconstruction and renovation of the building for the needs of the Jewish Theatre and the Labour Office. 2. Requirements for employment by the Contractor or Subcontractor of persons under an employment contract: 1) The Ordering Party requires employment by the Contractor or Subcontractor on the basis of an employment contract of persons performing the following activities in the scope of contract performance: a) general construction works, including in particular those carried out by a painter, plasterer, bricklayer, carpenter (excluding works whose performance requires appropriate permissions to perform independent functions in construction, e.g. construction manager); electrical and teletechnical works, including in particular assembly works of installations and equipment, with the exception of works the performance of which requires the possession of appropriate authorizations to perform independent functions; c) sanitary works, including in particular those carried out by the installer of installations and equipment (excluding works whose performance requires appropriate permissions to perform independent functions in the construction industry); d) works related to land development, including works in the field of making paved surfaces, roads and greenery. 2) During the performance of the contract, the Ordering Party is entitled to perform control activities against the Contractor regarding the fulfilment by the Contractor or Subcontractor of the requirement of employment under the employment contract of persons performing the activities indicated in point 1. The Ordering Party is entitled in particular to: a) request statements confirming compliance with the above-mentioned requirements and assessing them, b) request clarifications in the event of doubts regarding the confirmation of compliance with the above-mentioned requirements, c) carry out on-the-spot checks on the performance of the service. 3) During the performance of the contract at each request of the Ordering Party within the period specified in this request, the Contractor shall submit to the Ordering Party the specified proof/evidence in order to confirm the fulfilment of the requirement of employment by the Contractor or Subcontractor on the basis of the employment contract of persons performing the activities indicated in point 1. The documents referred to above should contain information necessary to verify employment on the basis of an employment contract, in particular: the name and surname of the employee employed, the date of conclusion of the employment contract, the type of employment contract and the scope of the employee's duties. 4) For non-compliance by the Contractor or Subcontractor with the requirement of employment under the employment contract of persons performing the activities indicated in point 1), the Ordering Party provides for a penalty in the form of an obligation for the Contractor to pay a contractual penalty in the amount specified in the PPU. Failure by the Contractor to submit within the time limit set by the Contracting Authority the evidence requested by the Contracting Authority in order to confirm that the Contractor or the Subcontractor has fulfilled the requirement of employment under the employment contract shall be treated as failure by the Contractor or the Subcontractor to fulfil the requirement of employment under the employment contract of persons performing the activities indicated in point 1. 5) In case of justified doubts as to compliance with labour law by the contractor or subcontractor, the contracting authority may request an inspection by the National Labour Inspectorate.
