In the present proceedings, the Municipality of Komorniki acts in its own name and on behalf of organisational units. 1. The subject of this contract is the comprehensive supply of electricity to the facilities listed in Annex 1 to the contract settled under the energy cooperative. The EPP included in Annex 1 to the agreement will be settled as part of the activity of the energy cooperative Energia Commune Komorniki Spółdzielnia Energetyczna, NIP 777-343-38-74. Article 38c of the Renewable Energy Sources Act of 20 February 2015 is the basis for the settlement of energy produced in renewable energy sources within cooperatives. 4. In the case of existing comprehensive contracts, which have a three-month notice period, the Employer requests their termination by mutual agreement of the parties, with effect from 31.12.2026. If it is not possible to terminate the contracts by mutual agreement, the date of entry into force of the order will automatically be postponed for the time necessary to terminate the comprehensive contracts. The EPP will be settled within the energy cooperative after the metering systems have been adjusted by the distribution system operator. 6. The detailed scope of the contract is set out in Annex 1 to the contract, in accordance with the Energy Law Act of 10 April 1997. The other conditions relating to the performance of the contract are set out in the draft provisions of the contract for the sale of electricity – Annex 2 to the FTZ. 7. The comprehensive supply of electricity will take place under the conditions laid down in the Energy Law Act of 10 April 1997, the Capacity Market Act of 8 December 2017 and in accordance with the implementing provisions issued to those acts, in particular the Regulation of the Minister for Climate and the Environment of 29 November 2022 on the method of shaping and calculating tariffs and the method of settlement in electricity trading and the Regulation of the Minister for Climate and the Environment of 22 March 2023 on detailed conditions for the operation of the electricity system. 8. The above provisions concern the method of calculation, settlement and quality parameters of the electricity supplied. 9. The reserve seller is: Enea SA. 10. The requirements (obligations) imposed on the Contractor are described in the draft provisions of the contract. 11. The Ordering Party shall grant the Contractor selected in the proceedings a power of attorney to: 1) notifying the relevant Distribution System Operator about the conclusion of a comprehensive electricity contract and about the planned date of commencement of electricity sales, 2) submitting a statement of termination of the existing comprehensive agreement for electricity consumption points included in Annex 1 to the contract and new consumption points, 3) representing the Ordering Party in contacts with the existing Electricity Seller or Distribution System Operator in matters related to the process of changing the Seller concerns the consumption points included in Annex 1 to the contract, 4) representing the Ordering Party in contacts with the Distribution System Operator in matters related to the process of notifying the Seller for new electricity consumption points, for which the Ordering Party received the contract number for the provision of electricity distribution services from the DSO. 12. Existing comprehensive contracts/electricity sales contracts with existing electricity sellers for the electricity consumption points included in Annex 1 to the contract are concluded for a limited period of time, and a detailed description for each of the EPP points can be found in the column entitled ‘Period of validity of the current contract/Terms of termination 13. Annex 1 to the contract indicates the current parameters (tariff group/contractual capacity) which may be subject to change during the duration of the electricity contract. 14. During the term of the Agreement, the Ordering Party has the right to change the tariff groups, the contractual power for individual PPE specified in Annex 1 to the Agreement after prior agreement on the technical conditions for making these changes with the Distribution System Operator, hereinafter referred to as the DSO.
