Description

The ZRF intends to commission a non-profit organisation or association pursuant to Article 2(14) of the BayRDG to carry out air rescue by means of a service concession on the basis of Article 16(2) in conjunction with Article 13(2), first and second sentences, (3), (5), first to third sentences and (5) of the Bavarian Rescue Service Act (BayRDG). The present selection procedure is subject solely to the provisions of administrative law, in particular those laid down in Article 2(14), the first and second sentences of Article 13(2), Article 13(3) and the first to third sentences of Article 16(5) of the BayRDG and the relevant provisions of the Bavarian Administrative Procedure Act (BayVwVfG). The provisions of Sections 97 et seq., 148 et seq. of the GWB and the KonzVgV do not apply in accordance with Section 107(1)(4) of the GWB. An administrative selection procedure is therefore carried out on the basis of a negotiated procedure with participation competition within the meaning of § 14(3) and § 17 VgV.
