Poland-Bełchatów: Refuse and waste related services
The subject-matter of the contract is a service consisting of the collection and management of municipal waste from the owners of properties located in the Municipality of Bełchatów during the period from 1.7.2018 to 30 June 2019. The subject matter of the contract was divided into three tasks. The scope of the contract concerns dwellings.
Task No. 1
Collecting and managing municipal waste from property owners where residents from the Municipality of Bełchatów live and equip all property owners with waste containers. The municipal waste collection system does not cover waste generated by economic activities.
Task No. 2
Collection and management of separately collected municipal waste
At the Selective Collection of Municipal Waste and equipped with appropriate waste collection containers. The point is located in Zawady, 97 – 400 Belchatów. The site is owned by the Municipality of Belchatów.
Task No 3
Operating a door-to-door collection system for large waste from households located in the Municipality of Belchatów, as scheduled, twice during the period covered by this contract.
A detailed description of the subject matter of the contract is set out in the amended Annex 2 to the ToR.
Employment condition.
As provided for in Article 29. 3a of the Public Procurement Law Act, the Contracting Authority requires the contractor or subcontractor to employ on the basis of an employment contract (within the meaning of the Labour Code of 26.6.1974) persons performing the following activities during the performance of the contract, i.e.: activities relating to the physical performance of the subject matter of the contract, i.e. drivers and crews of vehicles receiving municipal waste in the municipality, persons directly supervising the performance of the contract (including the receipt of complaints, receiving notifications concerning the obligation to deliver or collect containers, drawing up/transmitting documentation on the performance of the contract).
The contractor must maintain the above level of staff throughout the execution of the contract.

As regards the verification of the economic operator’s compliance with the requirements referred to in Article 29. 3A, and penalties for failure to comply with these requirements, the type of activities necessary for the performance of the contract, which are covered by the requirements for the employment of persons performing activities during the performance of the contract by the contractor or subcontractor, are set out in Section 16 of the draft contract, which forms the amended Annex 3 to the ToR.
The contracting authority does not reserve the obligation for the contractor to perform in person key parts of the contract in relation to the subject matter of the contract.
