4.1. The subject of the contract is the execution of construction works as part of the investment entitled: “Construction of multi-family buildings in the municipality of Szczytno”. 4.1.1. The subject of the contract is the construction of two multi-family residential buildings together with external and internal installations, including a gas installation and adjacent land development in Kamionek, on the plot number 6/144 area 0011 Lipowa GĂłra Zachodnia cadastral unit 281706_2 Szczytno. The purpose of the subject-matter of the contract is to create new dwellings made in accordance with the detailed description of the subject-matter of the contract, including a specific standard of finishing the premises. A detailed description of the subject of the contract can be found in Annexes 6 and 6a. 4.1.2. Within the framework of this contract, the contractor will be obliged to include in the valuation and execution of works, services and supplies resulting from the project documentation, including in particular projects, technical specifications for the execution and acceptance of works and blind estimates and other documents constituting Annex 6 to the FTZ. It is unacceptable to treat any of the elements of the documentation selectively, and in particular to ignore the scope resulting from the works/blind estimates, which are an integral part of the entire documentation. At the end of the investment, the executed object, which is the subject of the contract, will have to obtain an energy certificate (with a report from the thermal imaging test) of energy efficiency EP [kWh/m2 x year] ≀ 52 (smaller or equal). All the requirements set out in the documents indicated above are minimum requirements and their fulfilment is mandatory. Failure to meet the above-mentioned minimum requirements will result in the rejection of the tender as non-compliant with the terms of the contract on the basis of Art. 1 point 5 of the PPL Act. 4.1.3. The Contractor undertakes to carry out works in consultation with the Ordering Party in a safe manner, least burdensome for residents and users of neighboring plots within which the works will be carried out, allowing free use of the areas adjacent to the area on which the contract will be carried out. 4.2. The scope of the contract must also include (on the part of the Contractor) in particular: 1) Execution of expert opinions, studies, analyses and opinions necessary for the proper performance of the contract. 2) Execution of tests, regulations - including those compliant with the DNSH formula - of the principle of not doing significant harm to the environment (do no significant harm) min.: - Scenario of a building according to PN-EN 15978 standard. List of actions to effectively prevent noise, dust and pollutant emissions. − Declarations of performance or national declarations of performance or other documents proving that construction products have the required characteristics (for products related to water or containing dangerous substances). − Energy performance certificate for a building and individual dwellings - obtaining an indicator of annual demand for non-renewable primary energy max. to Ep < 52 kWh/m2 year. 3) Execution of construction works resulting from the FTZ, including in particular Annexes 6 to the FTZ, taking into account the explanations and changes made by the Employer (including the Employer's explanations regarding changes in the scope of construction works - Annex 6a included in Annex 8). 4) Providing construction management and individual project managers. 5) Securing and marking (on their own and at their own expense) the works carried out and taking care of the technical condition and correctness of the marking throughout the duration of the task. 6) Development and transmission to the Ordering Party of instructions for operation, operation of equipment and other documents related to the implemented investment. 4.3. The investment will be carried out in agreement with the Ordering Party. The Contractor undertakes to perform the contract in a safe, least burdensome manner and in a manner that does not result in the complete closure of the areas within which the work will be carried out. 4.4. The contracting authority informs that where it has described the subject of the contract in the FTZ by reference to standards, European technical assessments, specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the Public Procurement Law, the contracting authority shall allow solutions equivalent to those described and such reference shall be accompanied by words or equivalent.
