Supply and purchase of electricity for the Commune of Sosnowiec.

1.The subject of the contract is the supply of electricity and the repurchase of electricity generated in installations of renewable energy sources belonging to the Ordering Parties, carried out in accordance with the Energy Law, the Renewable Energy Sources Act, applicable implementing regulations and quality standards for customer service. A detailed list of energy consumption points, RES installations and the forecast volume of electricity covered by the contract is set out in Annex 2 to the FTZ – ‘Description of the subject-matter of the contract EE 2027-2028’. 2. The subject-matter of the contract includes: 1) the supply of electricity to the Contracting Authority's consumption points, 2) the purchase of electricity generated and fed into the grid from the Contracting Authority's RES installations, 3) the settlement of electricity according to the four groups of customers specified in the table below, for which the Contractor is obliged to offer separate unit prices of electricity applicable in 2027 and in 2028 respectively. Group 1 Street lighting All objects of street lighting and road signalling whose work is controlled automatically. Facilities may belong to DSO tariff groups: Oxx, Cxx, R Group 2 Premises and facilities other than street lighting All other facilities not included in Group 1 Facilities may belong to OSD tariff groups: Cxx Group 3 Facilities powered from the SN network All other facilities not included in Groups 1 and 2 belonging to the OSD tariff groups: Bxx Group 4 Facilities supplied from the Gxx tariff group All other facilities not included in Group 1 - 3 belonging to the OSD tariff groups: Gxx 3. The forecast electricity demand for the period from 01.01.2027 to 31.12.2028, broken down into tariffs, is set out in an excell file marked: ‘Description of the subject-matter of contract EE 2027-2028’; the Volume tab. 4. Repurchase of electricity generated in RES installations 1) The contract also covers the receipt and settlement of electricity entering the distribution network from renewable energy sources installations belonging to the Contracting Authority; 2) The Contractor will be obliged to conclude a contract with the Contracting Authority regulating the rules for the repurchase of electricity fed into the network, in accordance with the requirements set out in this FTZ and Annex 5a) to the FTZ ‘Minimum requirements for an electricity repurchase agreement’; 3) The Contractor is obliged to prepare a draft power repurchase agreement meeting the requirements set out in the FTZ and Annex 5a to the FTZ; 4) The method of accounting for electricity entering the grid will depend on the legal status of a given RES installation and applicable legal provisions. 5. The contracting authority specified the detailed conditions for the performance of the contract in the draft provisions of the contract, which constitute Annex No 5 to the FTZ – PPU. 6. Electricity distribution services will be provided on the basis of separate agreements concluded between individual Customers (customers/payers) and the relevant distribution system operator (DSO).
