The Ordering Party allows the possibility of submitting tenders for the selected Group or Groups (1 - 17). Offers in Groups 1, 2, 3, 4, 5, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17 must be complete - complete. The Ordering Party does not allow the absence of any item of the assortment listed in each of these groups. In the scope of Group 6, the Ordering Party allows the absence of a maximum of 20 (twenty) items of drugs listed in the Group. 3. A detailed description of the needs of the Ordering Party, i.e. the type, number of assortment and size of medicine packages in individual Groups, is provided in the Assortment and Price Form - Appendix No. 2 to the SWZ. 4. The Ordering Party reserves that the quantities of the assortment indicated in Appendix No. 2 are estimated quantities used to calculate the price of the offer, compare offers and choose the most advantageous offer. Purchases made during the term of the contract may, for individual Groups, differ quantitatively from the values given in Appendix No. 2 to the CVT, depending on the needs of the Ordering Party and the number of patients, however, the reduction of ordered deliveries will not exceed 20% of the gross value of the Contractor's offer selected in the Group. The Contractor shall not be entitled to claim for the order of a smaller quantity of assortment than specified for individual Groups 1 to 17, in Annex 2 to the TMS. 5. If the SWZ uses markings or parameters indicating a specific manufacturer, a specific product, trademarks, patents or origin, the Ordering Party allows the use of equivalent solutions, which should be understood as products with parameters not inferior to those presented in the description of the subject of the contract and meeting, at least to the same extent, the requirements of the Ordering Party. The Contractor referring to equivalent solutions described by the Contracting Authority is obliged to demonstrate in the tender that the products offered by him meet the requirements of the Contracting Authority. 6. The subject of the contract must be authorised for marketing and use on the territory of the Republic of Poland in accordance with the applicable provisions, in particular in accordance with the Pharmaceutical Law Act of 6 September 2001 (Journal of Laws No. Journal of Laws 2024, item 1710). The Contracting Authority reserves the right to ask contractors at the stage of examination and evaluation of tenders, as well as during the term of the contract for the submission of summaries of the offered medicinal products and documents authorising the marketing and use of the offered products in Poland.
