Description

HungaroControl Zrt., as the Air Navigation Service Provider of Hungary (Air Navigation Service Provider: ANSP) modernizes ATC (Air Traffic Control) facilities. As part of the project, the Contracting Authority intends to purchase 3 modern (solid) Surface Movement Radar (SMR). The contracting authority’s objective is to obtain a system for which it wishes to obtain the approval of the Transport Authority. This is subject to the condition that the Manufacturer is certified in accordance with Commission Delegated Regulation (EU) 2023/1768 (hereinafter: Certification Regulation) OR, if it does not have such a certificate in accordance with the transitional provisions laid down in Article 7(3) of the Certification Regulation, the manufacturer shall provide the necessary documents (e.g.: the technical compliance matrix for demonstrating compliance with Regulation (EC) No 552/2004 or Regulation (EC) No 1139/2018 of the European Parliament and of the Council for the system) to the Contracting Authority. (hereinafter: In view of the provisions of Section 46(3) of the Government Decree, the contracting authority draws attention to the fact that, if the clear and comprehensible definition of the subject-matter of the public procurement necessitated a reference to a specific make, origin, type of thing, procedure, activity, person, patent or trade mark, the name was used only in order to clearly define its subject-matter and, in addition to the name, the term ‘or equivalent’ must always be understood. The contracting authority draws attention to the fact that if an equivalent is offered, the tenderer must prove the equivalence in its tender.
