Sienkiewicza 24/26, Tax ID: 8790177233, REGON: 341227892, District Court in Toruń VII Commercial Division of the National Court Register: 0000406721, share capital: 91.069.000,00 zł, phone: 56 655 52 00, fax. 56 655 53 39, e-mail: establishment@mzk.torun.pl, address of the website of the proceedings: https://mzk-torun.eza nakazjacy.pl Information on the subject of the contract: 1.Delivery of 500 kVA/400 kW generator set and 250 kVA/200 kW generator set. 2.The contracting authority shall divide the contract into two lots: Part 1 – Supply of a 500 kVA/400 kW power generator; Part 2 – Supply of a 250 kVA/200 kW generator. 3.The Contracting Authority shall allow for the possibility of submitting partial tenders divided into 2 lots. The offer can be placed for any number of parts of the order. 4.In the case of describing the subject of the contract by indicating the trademarks, patents or origin, source or specific process that characterizes the products or services provided by a specific contractor, the Ordering Party allows solutions equivalent to those described taking into account the provisions of: The contracting authority made every effort to describe the subject-matter of the contract in an unambiguous and exhaustive manner, using sufficiently precise and comprehensible terms, taking into account all the requirements and circumstances that may affect the preparation of the tender. However, wherever the FTZ indicates trademarks, patents or origin, sources or a specific process that characterises the products or services provided by a particular Contractor, it means that the Contracting Authority could not describe the subject-matter of the contract in a sufficiently precise and comprehensible manner, and such indication means the possibility of using a solution or equivalent product so as not to favour or eliminate certain contractors or products. The required equivalence characteristics are determined in each case by the limit parameters and functional requirements indicated for the element of the subject-matter of the contract. 5.In the case of describing the subject of the contract by means of standards, technical assessments, technical specifications and technical reference systems, the Ordering Party allows solutions equivalent to those described taking into account the following provisions: Wherever specific standards or regulations are referred to in the FTZ, the provisions of the latest edition or revised edition of the standards and regulations referred to shall apply. Where the standards and regulations referred to are national or relate to a particular country or region, other appropriate standards providing substantially equal or higher levels of performance than the standards or regulations referred to may also be applied, subject to their prior verification and written approval by the Contracting Authority. 6.Whenever the description of the subject of the contract refers to standards, technical assessments, technical specifications, technical reference systems referred to in Art. 1 point 2 and paragraph. 3 of the Public Procurement Act, the Contracting Authority allows equivalent solutions provided that the Contractor proves in the tender, in particular by the means of evidence referred to in Articles 104-107 of the Public Procurement Act, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent extent. The Ordering Party considers the solution to be equivalent, which makes it possible to obtain the effect assumed in the description of the subject-matter of the contract by means of other technical solutions or parameters not inferior to those required and described in the FTZ.
