Ignacy Skorupki 21 90-532 Łódź tel.: +48 (42) 638-48-88 e-mail:zarządenia@uml.lodz.pl PKT z SWZ: 40.1 The Ordering Party does not provide for: 40.1.1. the conclusion of a framework agreement; 40.1.2. submission of variants and partial offers; 40.1.3. settlement in foreign currencies; 40.1.4. electronic auction 40.1.5. reimbursement of costs of participation in the proceedings; 40.1.6. the possibility of awarding a contract consisting in the repetition of similar services on the basis of Art. 1 point 8 of the Public Procurement Act 40.1.7. the requirement or possibility of submitting offers in the form of electronic catalogues· or attaching electronic catalogues to the offer; 40.1.8. An on-site inspection by the Contractor or verification by the Contractor of the documents necessary for the performance of the contract available on the spot from the Contracting Authority. 40.2 The Employer provides for an option right under Article 441 of the PPL – The Employer may exercise the option right during the term of the contract. 40.2.1 The Purchaser, during the term of the contract, may exercise the right of option and increase the number of deliveries, but not more than by: a) for the City of Łódź – Łódź City Hall - 95% of the contract value, b) for the Social Benefits Centre - 50% of the contract value, c) for the Shared Education Services Centre - 20% of the contract value, d) for the Łódź Geodesy Centre - 30% of the contract value, e) for the Municipal Social Welfare Centre - 100% of the contract value, f) for the Management Board of Municipal Premises - 50% of the contract value. 40.2.2 The exercise of the right of option may take place if it is necessary to ensure continuity of the supplies covered by the contract, as a result of increased demand for the subject-matter of the contract. If the Employer exercises the right of option, the settlement of this part of the supplies will be made using gross unit prices, given in the annex to the contract, subject to a change in VAT rates. The rights and obligations of the Contractor and the Ordering Party, as well as the rules for settling deliveries resulting from the right of option, shall apply in full to the provisions of the contract. The delivery period for the deliveries resulting from the option right will take place under the conditions set out in the Contractor’s tender for the basic contract 40.2.4 The scope of the option right is indicated in the Description of the subject-matter of the contract – Annex 1 to the FTZ and in the model contract – Annex 5 to the FTZ. 40.3 Prior to the initiation of the procedure, the contracting authority did not conduct preliminary market consultations. 40.4 Scope and conditions of amendments to the concluded contract - issues relating to the contract are regulated in the model contract Appendix No. 5 to the FTZ
