Description

Definition of the subject matter and size or scope of the contract:
1. The subject-matter of the contract is the supply to the Contracting Authority of specialised laboratory reagents intended for the continuation of scientific and research work carried out for innovative, development and research projects and the completion of research, the results of which are the subject of scientific publications. A detailed list of the subject-matter of the contract is set out in Annex 1 to the ToR. Only one tender may be submitted by each Contractor.
2. In order to ensure continuity and homogeneity of research, robustness and reproducibility of the results in the scientific research carried out, the Contracting Authority, in the description of the subject-matter of the contract, i.e. specialised reagents, also indicated the brand name of the products, i.e.: GE Healthcare and catalogue numbers of reagents currently in use. The indication of the brand name of the product or the catalogue numbers does not directly indicate the Contractor’s successive delivery. A tender may be submitted by any Contractor interested in obtaining and performing the contract.
3. Contracting authority, in accordance with Article 29, paragraph 3 of the Public Procurement Act allows for the possibility of equivalent tenders with parameters and characteristics not lower than those specified by the contracting authority. In this case, the Contractor shall:
(a) attaching together with the offer of a reagent safety data sheet and/or a quality specification containing the basic data and the physical and chemical requirements of the reagent in question;
(b) attach quality analysis certificates or other equivalent certificates for the subject-matter of the contract offered in Polish. The document must contain at least: manufacturer’s name, catalogue number, chemical composition, purity, shelf life.
(C) demonstrating by supplying test samples that the reagents offered meet the requirements laid down by the Contracting Authority and are the same in terms of analytical characteristics;
(D) demonstrating, by supplying samples for testing, that the reagents offered by him meet the requirements for the continuation of scientific research carried out by the Contracting Authority, without the need for additional activities (procedures), including e.g. calibration;
(e) demonstrating by supplying test samples that the use of specialised reagents with equivalent parameters/appropriations does not require the acquisition of additional reagents and other consumables.
4. Compliance with equivalence will be assessed on the basis of the documents and samples attached by the Contractor, as indicated in point. II.1.3) 4 a-d. Failure to demonstrate compliance with equivalence shall result in rejection of the Contractor’s tender from the procedure under Article 89. 1 point 2 of the Public Procurement Act, after exhaustion of the action taken to supplement the documents, as not corresponding to the content of the ToR.
5. At the same time, the Contracting Authority would inform you that:
(a) samples of reagents included in the offer must be sufficient to carry out the test/analysis with a minimum of 50 repetitions;
(b) vials and containers containing reagents must be supplied in a group package (separate envelope or other packaging other than the tender submitted), with the name and address of the Contractor, the name and mark of the procedure, with the words ‘samples of reagents for tests confirming equivalence’;
(C) each vial or container of reagent must be described in such a way that it can be identified from part No, item number of the specified reagent in accordance with the numbers in Annexes 1 and 3, the name of the reagent offered in accordance with Annex 3.
6. Tests/analysis of the reagents supplied will be carried out during the tender examination period, in accordance with the time limit for binding the tender, carried out by the academics for whom the reagent is ordered. The results obtained will be compared with the results of the tests/analyses carried out by the Contracting Authority in the 6 months prior to the announcement of the procedure, on reagents conforming to the specifications, the manufacturer and the catalogue number indicated in the ToR (‘the model’). The procurer will accept the reagents offered, the results of which in the tests/analyses carried out will not indicate greater differences than 5 % (in terms of repeatability of the results obtained, values of the test series of samples higher or lower than the “benchmark”). The results of the tests/studies carried out from the different lots will be sent to the Contractors who submitted tenders for the lot in question by e-mail and on paper.
7. The assessment of equivalence described above will be carried out on the principle 0-1 (fulfills/does not comply).
8. The Contractor shall provide samples of reagents for the tests/analyses at his own expense. All samples following an equivalency test remain attached to the tender documentation.
9. The contracting authority cannot predict which reagents listed in Annex 1 will be required to carry out the tests at the various stages of the scientific work to be carried out. The contracting authority will place successive orders for individual reagents at the unit prices indicated by the Contractor in Annex 1. Orders will be placed successively for a 12-month contract period. The contract may be terminated earlier if the amount allocated to the Contracting Authority for the purchase of reagents for carrying out scientific work is exhausted (i.e.: PLN 369000).
10. The duration of the warranty for reagents shall not be less than 75 % of the period normally offered by the manufacturer.
11. Successive delivery, time limit for completion: 12 months from the date of signature of the Agreement. Time limit for partial delivery: up to a maximum of 21 days from the date of dispatch of the order. The volume of each delivery will be specified and sent to the Contractor by e-mail or fax, indicating the address, the establishment and the person to whom the reagents must be supplied. Sub-orders will be placed 2-4 times a month.
