The medbo requires a KMS KEY (volume license), which can be activated on an in-house medbo license server (Windows Server) and made available to the clients 1. The requirements relating to second-hand licences are set out as follows: assurances by the tenderers in the form of self-declarations that the requirements of the ECJ / BGH are met, namely: the licences offered were originally placed on the market in the European Economic Area; b) the right granted with the purchased licence has been granted permanently (indefinitely); equitable remuneration has been paid in return for the licence; d) with the purchase of the software the first purchaser has been entitled to use updates or additions to the products, the pre-release code, additional functions e) the first purchaser has rendered his copy unusable; f) the granting of the intended right of use of the offered software is guaranteed. 2. A TÜV IT certificate proving the secure transfer of licences is required under public procurement law, but ‘other appropriate evidence’ is also permitted in this context in order to comply with the requirements of public procurement law and not to restrict competition. 3. In addition, a declaration of exemption is also included in the tender collection documents, under which the tenderer is obliged to indemnify the contracting authority against claims of the software manufacturer in the event that the contracting authority is used in or out of court for infringements of the lawfulness of the purchasing chain. In return, the contracting authority undertakes to coordinate all extrajudicial and judicial measures with the tenderer and to conduct the proceedings by mutual agreement. 4. In addition, the contracting authority reserves the right to impose on the tenderer the obligation to deposit the original documents and supporting documents of the chain of rights with a neutral authority, so that this can be accessed by the contracting authority, e.g. in the event of insolvency. We kindly ask you to take this into account in your calculation, as such a deposit will incur costs that the bidders are likely to have to include in the calculation.
