Description

1. The subject of the contract is a comprehensive service for the organisation and implementation of a study visit in Riga (Latvia) for a group of 10 participants (not including technical support), including transport, accommodation, food, translation, coordination and logistics services under the project ‘Implementation of the Waste Management Plan for the Pomeranian Voivodeship (PGOWP) taking into account the hierarchy of municipal waste management and the principles of circular economy (GOZ)’ – LIFE Pom GOZilla.PL, a project co-financed by the European Union under the LIFE Programme and by the National Fund for Environmental Protection and Water Management. 2. A detailed description of the subject-matter of the contract is set out in Annex 1 to the FTZ and in the model contract, which is Annex 2 to the FTZ. 3. The law applicable to this contract (including the contract concluded as a result of this procedure and the assessment of the legal effects of all documents in this contract) is Polish law, taking into account European Union law. 4. In all provisions of the FTZ and its annexes, in which the Contracting Authority refers to standards, approvals, technical specifications or reference systems or indicates trademarks, parameters or sources of origin (names of manufacturers or equipment), in accordance with Art. 5 and Article 101 para. 4 of the PPL Act, the Employer allows equivalent solutions. 5. If the description of the subject of the contract contains the names of materials and products of specific manufacturers, this should be considered only as a specification of the desired standard and quality. In all such situations, the Contractor may offer equivalent materials, products with at least the same technical and quality characteristics. Product equivalence is understood as offering a product whose technical parameters of the materials used, performance, durability and quality are not inferior to the quality of the materials, products described in the FTZ. 6. The Contractor who invokes equivalent solutions is obliged to demonstrate that the solution offered by him meets the requirements specified by the Ordering Party. In such a case, the Contractor shall attach to the tender a list of equivalent solutions together with its description or standards. 7. The Ordering Party does not reserve the obligation for the Contractor to personally perform the key parts of the contract. The Contractor may entrust the performance of part of the contract to a Subcontractor. 8. Subcontracting: 1) The Contractor may entrust the performance of part of the contract to a subcontractor (subcontractors). 2) In connection with the performance of the contract, the Ordering Party does not reserve the obligation to personally perform the key tasks of the contract. 3) In the event of subcontracting, the contracting authority shall require the contractor to indicate in the tender the parts of the contract which it intends to subcontract and, if already known, the names of those subcontractors. 4) Entrusting parts to subcontractors does not release the contractor from responsibility for the proper performance of the contract. 9. The Contracting Authority does not reserve the possibility of applying for the contract only by the Contractors referred to in Article 94 of the Public Procurement Act. 10. The Contracting Authority does not provide for an obligation for the Contractor to carry out an on-site inspection and for the Contractor to check the documents necessary for the performance of the contract available on the spot from the Contracting Authority. 11. The contracting authority does not allow the possibility of submitting a variant offer referred to in Article 92 of the Public Procurement Act, i.e. an offer providing for a different way of performing the contract than specified in this FTZ. 12. The contracting authority does not provide for the conclusion of a framework agreement and the establishment of a dynamic purchasing system and does not provide for the selection of the most advantageous tender using an electronic auction. 13. The contracting authority does not provide for the award of contracts on the basis of Art. 1 point 7 of the PPL Act. 14. The Ordering Party does not allow the submission of an offer in the form of electronic catalogues or the attachment of electronic catalogues to the offer, in the situation specified in Article 93 of the Public Procurement Act. 15. The Ordering Party does not provide for settlement in foreign currencies. Order settlement is carried out in PLN. 16. The contracting authority does not provide for reimbursement of the costs of participation in the procedure. 17. The contracting authority does not provide for advance payments to be made for the performance of the contract. 18. The contracting authority does not allow partial tenders to be submitted. 19. Justification for not dividing the contract into lots: The subject-matter of the contract is functionally integrated and covers interdependent services, in particular international and local transport, accommodation, food, translation services, coordination and comprehensive logistical and organisational services for the study visit. The separation of these elements between the different economic operators could lead to: 1) loss of organisational consistency, 2) increase in contract implementation costs, 3) difficulties in coordinating the implementation of individual services, 4) increase the risk of delays or disruptions in the implementation of the study visit programme, 5) decrease in the quality of services provided. The contract was prepared taking into account the principle of maintaining fair competition and ensuring that small and medium-sized enterprises can apply for the contract. The scope of the contract and the description of the subject-matter of the contract do not restrict competition and do not hinder access to the contract for contractors with appropriate experience and potential for its implementation.
