Supply of electricity as part of a comprehensive service for the purpose of powering premises and buildings and street lighting in the period of 12 months from 01.01.2026 to 31.12.2026 for the Chorzele Commune and subordinate units.
1) The subject of the contract is ‘Supply of electricity as part of a comprehensive service for the supply of premises and buildings and street lighting in the period of 12 months from 01.01.2026 to 31.12.2026 for the Municipality of Chorzele and subordinate units’. 2) Supply of Electricity as part of the comprehensive service in the period from 01.01.2026 to 31.12.2026. 3) Projected energy consumption in the period of 12 months from 01.01.2026 to 31.12.2026 amounts to a total of 2 258,521 MWh. 4) The list of collection points and the expected consumption in the points contains the Description of the subject-matter of the contract – the list of EPP – Annex 13 to the FTZ. 5) The Ordering Party informs that the Distribution Services Operator for the energy consumption points covered by the proceedings is PGE Dystrybucja S.A. The Seller is PGE Obrót S.A.. Comprehensive contracts. 6) The Customer declares that the expected consumption is only an approximate value, which may be reduced or increased. Regardless of the amount of actual consumption, the Seller is obliged to use the energy price offered in the tender offer. The Seller may not claim from final customers any claims if, during the term of the contract, final customers purchase less or more electricity than expected, in particular due to an increase or decrease in the number of energy consumption points, a change in the tariff group, a change in the power ordered or technical parameters of energy consumption points, actual energy consumption. 7) In the event of an increase in the Ordering Party's demand for electricity during the term of the contract, the Ordering Party reserves the right to increase the volume of the order to 10% in relation to the size of the basic order specified in the Terms and Conditions of the Order - the right of option. 8) At PPE points where photovoltaic installations are installed, the Contractor shall conclude with the Contracting Authority appropriate energy repurchase agreements on the model contracts submitted by the Contractor. 9) Electricity should meet technical parameters in accordance with the provisions of the Energy Law Act and its implementing regulations and Polish Standards. 10) Electricity will be used for the needs of the final customer. 11) The estimated amount of energy supplied during the delivery period is 2 258,521 MWh. Detailed information on individual points of electricity consumption presented in the summary table constituting Annex 9.1 to the model contract for the sale of electricity (Annex 9 to the SWZ). 12) The contract covers the sale of electricity to 171 electricity consumption points, for which the following entities are the payers of invoices: the municipality of Chorzele; b) Centre for Dissemination of Culture in Chorzela; c) Municipal Public Library in Chorzely; 13) Each of the above-mentioned payers shall conclude a single contract with the Contractor covering all energy consumption points belonging to the payer. The data necessary for the conclusion of individual agreements are set out in Annex 9 to the FTZ. 14) The Contractor selected in the proceedings in the name and on behalf of the Ordering Party shall perform the following actions resulting from the procedure of changing the seller in relation to the electricity consumption points to which the contract relates: a) notifying the relevant Distribution System Operator for the implementation of the comprehensive electricity sales contract concluded with the Contractor, b) submitting declarations of intent regarding the termination of existing electricity sales contracts, provision of distribution services and comprehensive contracts. 15) For this purpose, the Ordering Party shall grant the Contractor a power of attorney in accordance with the model set out in Annex 9.2 to this FTZ. The Ordering Party shall provide the Contractor with the information necessary to carry out the processes of changing the energy seller, in particular the periods of validity of current contracts and the periods of termination of current contracts for the sale of electricity. 16) The amount of electricity planned by the contracting authority, the DSO tariff group and the contractual capacity for individual PPE may change, i.e. increase or decrease, depending on actual needs. The changes may concern: the number of power consumption points, the amount of energy, the amount of contractual power in the range for: the abandonment of energy consumption points due in particular to the transfer, sale, rental to another owner, closure, decommissioning, (b) the creation of new energy consumption points or the takeover of energy consumption points from other entities. The settlement of additional demand points will take place at the same electricity unit prices and tariffs for distribution services and under the same conditions as specified in the offer and the content of the FTZ. (Increasing the consumption points or changing the tariff group is possible only within the tariff groups that have been included in the FTZ and valued in the Contractor's Tender Form). c) changes in electricity demand and power at a given consumption point. (The Ordering Party may increase the connection/contractual capacity to the facilities within the tariff groups specified by the Ordering Party. The change in the connection capacity will take place after the Employer has carried out all activities related to the change in the connection conditions with the DSO and provided ‘Confirmation of the possibility of providing a distribution service and determination of the technical delivery parameters’ or a decision has been issued by the DSO. Changing the connection conditions may involve the need to adapt, at the expense of the Customer, under the conditions specified by the DSO, the power equipment (including the metering and settlement system for connection groups II and III) to the new conditions for the supply of electricity or the implementation of new connection conditions).
