1. The subject of the contract is the sale and successive delivery of pharmaceutical products for the needs of the hospital pharmacy of the Independent Public Team of Health Care Establishments with its registered office at 27-300 Lipsko ul. J. Śniadeckiego 2, hereinafter referred to as the contracting authority, divided into 21 packages. A detailed description of the subject-matter of the contract is set out in the assortment and price form (Annex 2 to the SWZ ). 2. Equivalent tenders may be submitted provided that the equivalent of the original finished medicinal product is a medicinal product having the same qualitative and quantitative composition of the active substances, pharmaceutical form and bioequivalence with the original medicinal product, as confirmed, if necessary, by well-performed bioavailability studies; the concept of an equivalent to an original finished medicinal product also applies to various non-modified-release pharmaceutical forms intended for oral administration containing the same active substance, in particular tablets and capsules. 3. The subject of the contract offered must have valid documents allowing for release for free circulation on the territory of the Republic of Poland in accordance with the provisions of: • the Pharmaceutical Law Act of 6 September 2001 (i.e. Journal of Laws 2017, item 2211, as amended) – does not apply to medicinal products imported by way of final import; • Medical Devices Act of 7 April 2022 (Journal of Laws 2022, item 974 as amended. ) • Act of 25 August 2006 on food and nutrition safety (i.e. - Dz. Journal of Laws 2018, item 1541 as amended) and the Regulation of the Minister of Health on foodstuffs intended for particular nutritional uses (i.e. Journal of Laws 2015, item 1026), if applicable.
