Description

1. The subject of the contract is: transport of students (children) with disabilities to schools from 1 September 2025 to 31 August 2026 (in accordance with the provisions of the Education Act of 14 December 2016) in two parts – Part I, i.e. Division I and Part II, i.e. Division II. The transport service consists in delivering students (children) with disabilities residing in Warsaw in the Praga-Południe district from home to school and back, together with providing them with care during delivery, on all school days, in accordance with the school timetable and individual instructions of the school director, in the period from 2 September 2024 to 29 August 2025. assistance with boarding and disembarking, unfolding/assembling strollers, access to the school building (cloakroom or classroom). 2. The following shall be transported: a) pupils with disabilities attending primary schools, including special schools and school-education centres, b) pupils with motor disabilities, moderate or severe mental disabilities to the nearest upper secondary/secondary school, c) pupils with combined disabilities, one of which is an intellectual disability to a school-education centre, d) five- and six-year-old children with disabilities to a kindergarten, a kindergarten unit in a primary school or other form of pre-school education. 3. Pupils (children) should be brought to school in such a time as to enable them to start at the time of instruction and to be picked up at the end of instruction, without undue expectation, but with a view to the completion of instruction by other pupils (children) brought to the same school so that the weekly timetable of the pupils (children) of the school concerned can be adhered to. 4. Pursuant to Article 21 of the Act of 16 May 2016 on Counteracting Threats of Sexual Crime and on the Protection of Minors (Journal of Laws No. Journal of Laws 2024, item 560 as amended), in the case of employment or admission of persons to activities related to the care of minors, the employer is obliged to check whether the data of the employed or admitted person are included in the Register of Offenders on Sexual Background. The performance of the service was divided into two separate lots, hereinafter referred to as the ‘Districts’, taking into account the territorial division of the City: REJON I includes transporting students (children) with disabilities to schools located in right-bank Warsaw and neighboring municipalities. REJON II includes transporting students (children) with disabilities to schools located in left-bank Warsaw and neighboring municipalities. The detailed scope of transport is set out in Annex 2a and 2b to the SWZ – price form – detailed scope of transport for Division I and Division II (which will constitute Annexes 1 to the contracts) and the model contract constituting Annex 10 to the SWZ. Additional obligations of the Contractor resulting from the social clause based on Art. 1 of the Public Procurement Law Act, the Contracting Authority applies the Social Clause in the procedure in question pursuant to Article 95 of the Public Procurement Law Act of 11 September 2019 (Journal of Laws 2024, item 1320 as amended).
