SUBJECT OF THE ORDER 1.The subject of the contract is the provision of a service of physical protection of persons and property of the Ordering Party, including its premises and facilities, as well as any movable property (also entrusted to the Ordering Party by third parties) and rolling stock (excluding rolling stock in urban traffic) against destruction, damage, loss or theft. The service does not include convoying. 2.The description of the subject of the contract is presented in Annex No 12 to the FTZ, the conditions for the performance of the contract are set out in Annex No 13 to the FTZ (draft contract). 3.Before submitting an offer, the Ordering Party requires a local vision of the objects indicated in the description of the subject of the contract, in consultation with the persons indicated in §9 sec. 1 draft contract (for individual sites). Failure to make an on-site inspection of any of the objects indicated in the description of the subject of the contract, before submitting the offer, will result in its rejection on the basis of Art. 1 point 18) of the PPL. The Ordering Party shall verify the completion of the on-site inspection on the basis of written confirmations of the authorised representatives of the Ordering Party, submitted by the Contractor in an annex to the tender form or confirmations held by the persons indicated in §9 sec. 1 draft contract (for individual sites). 4.In the event that the Contractor has carried out the required on-site inspection of all objects in the invalidated proceedings, with the same case mark (WZ-091-99/25), the Contracting Authority will consider the requirement to carry out a on-site inspection to be fulfilled. II. DESCRIPTION OF THE REFUNDED PROCEDURE 1. The contracting authority provides for the possibility of applying the reversed order of evaluation of tenders referred to in Article 139 of the Public Procurement Law. 2. If the reverse order of evaluation of tenders is used, the Contracting Authority will first examine and evaluate the tenders, and then make a qualitative selection of the Contractor whose tender was the highest rated, in terms of the lack of grounds for exclusion and compliance with the conditions for participation in the procedure. 3. The Contractor shall not be obliged to submit the declaration referred to in Art. 1 PZP (JEDZ). The contracting authority shall require the submission of this declaration only by the Contractor whose tender has been the highest rated. 4. If the Contractor referred to in paragraph. 2, there are grounds for exclusion, this Contractor does not meet the conditions for participation in the procedure, does not submit subjective evidence or a statement referred to in Art. 1 PPL, confirming the absence of grounds for exclusion or meeting the conditions for participation in the procedure, the Contracting Authority shall re-examine and evaluate the tenders of the other Contractors, and then make a qualitative selection of the Contractor whose tender was the highest rated, in terms of the absence of grounds for exclusion and meeting the conditions for participation in the procedure. 5. The contracting authority shall continue the procedure for the re-examination and evaluation of tenders referred to in paragraph. 4, in relation to the tenders of the Contractors remaining in the procedure, and then make a qualitative selection of the Contractor whose tender was the highest rated, in terms of the absence of grounds for exclusion and compliance with the conditions for participation in the procedure, until the selection of the most advantageous tender or the annulment of the procurement procedure. 6. In the case of joint competition by the Contractors, the declaration referred to in para. 3, shall be submitted by each of the Contractors jointly applying for the award of the contract. These declarations confirm that there are no grounds for exclusion and that the conditions for participation in the procedure or the selection criteria are met, to the extent that each Contractor demonstrates compliance with the conditions for participation in the procedure or the selection criteria. III. The SEDZ form must be drawn up in accordance with the form set out in Commission Implementing Regulation (EU) 2016/7 of 5 January 2016 establishing a standard form for the European Single Procurement Document.
