1. The subject-matter of the contract is services relating to:forest management, logging and scrapping, nursery and seed work and forest fire protection planned for the Wolsztyn Forest District in 2015.
The contract was divided into 14 lots (packages). The working surfaces are located in forest areas: Obra, Wolstein, Zbąszyń.
2. The location and estimated size of the tasks to be performed in the individual packages are specified in Annexes 2a to the ToR (description of the subject-matter of the contract).
3. The contracting authority authorises the submission of partial tenders for the works specified in Annex 2 a-m to the ToR and Annexes 3 and 4 to the ToR. The contract is divided into lots, hereinafter referred to as ‘packages’:
(1) package 1 – Dąbrowa forestry;
(2) package 2 – Kębłowo forestry;
3) Package 3 – Scale forestry;
(4) package 4 – Jaromierz forestry;
(5) package 5 – Belęcin forestry;
(6) package 6 – Forestry New Tlooks;
(7) package 7 – Flood forestry;
(8) package 8 – Kopanica forestry;
(9) package 9 – Forestry Revenue;
(10) package 10 – Huta forestry;
(11) package 11 – New Dwór forestry;
(12) package 12 – Stefanowo forestry;
(13) package 13 – forest nursery and seeding;
(14) package 14 – forest fire protection.
The scope of the work to be carried out in the individual packages and the detailed location of the working areas are detailed in Annexes 2 a-m to the ToR and, in the case of timber harvesting work, in Annexes 3 and 4 to the ToR. The sizes of the individual activities are estimated and cannot be considered as definitive and are given in order to give the Contractors a common basis for drawing up and evaluating tenders. Payments shall be based on the actual quantities of services ordered and delivered, measured and indicated in the acceptance report, and the unit prices for the activities in question as indicated in the tender. A detailed description of the work for each lot (package) is set out in Annex 15 a-m to the ToR.
The contractor may submit a partial tender for 1 or more lots. For 1 lot (1 package), the Contractor may submit only 1 tender – in accordance with the model set out in Annex 1 to the ToR.
4. Additional conditions relating to the subject-matter of the contract.
Conditions for carrying out and financing the task:
(1) implementation of the subject-matter of the contract will be carried out successively. The dates and order of execution of the individual works listed in Annex 2 a-m to the Specifications for the Significant Terms of Reference, hereinafter referred to as ‘SIWZ’, shall be specified in orders issued by the competent forestry authorities and signed by representatives of the Contractor and the Contracting Authority;
(2) quantitative and qualitative collection of works will be carried out by the competent foresters. Acceptance of the works will be confirmed in writing by the forestry operator in the work acceptance report drawn up by the Contracting Authority. The report of acceptance of the works confirmed by the forestry company is the basis for issuing an invoice for the service provided by the Contractor. The service charge will be paid by transfer to the account within 20 days of the date of submission of the invoice. The report on acceptance of the works, signed by the representatives of the Contractor and the Contracting Authority, is also a document certifying the completion of the work ordered in a given month on a given area. In the case of partial acceptance of works, the completion of the works ordered in a given month shall document the last report for the final (last) part of the work performed. The order and detailed timing of the works will depend on their seasonality and the needs arising from the specific characteristics of forest management. The time limit for the execution of the works and their receipt shall not exceed the calendar month for which the order is issued;
(3) The contracting authority allows timber to be harvested using multi-operational machinery and the order and settlement will take place as when the timber is harvested with sawing. These machines can only be operated by persons with the necessary privileges. For logging, the Contractor will use chain saw spreads in saws, harvesters and forwarders, biodegradable oil;
(4) the work of multi-operational machinery may take place only on pre-designated operational routes by the Contracting Authority’s staff;
(5) The Contractor is obliged to use biodegradable oil for chain saw lubrication in equipment operated for the performance of the subject-matter of the contract with a biodegradability parameter not lower than 89 %. The required biodegradability test must be carried out in accordance with standard CEC-L-33-A-94, developed by the European Coordinating Committee for the Testing of Marrows and Engine Fuels (CEC-L);
(6) The contracting authority must provide the Contractor with the opportunity to purchase biodegradable oil with a biodegradation performance of not less than 89 %, and the Contractor shall purchase it in a quantity that ensures the performance of the work ordered. The oil will be coloured green;
(7) The Contractor may use biodegradable oil purchased from another supplier for chain saw lubrication under the following conditions:
(a) an oil test document of not less than 89 % biodegradation shall be provided;
(b) the required biodegradability test must be carried out in accordance with standard CEC-L-33-A-94, developed by the European Coordination Committee for the Testing of Marrows and Engine Fuels (CEC-L);
(C) provide a safety data sheet for the dangerous preparation (pursuant to the Act of 25.2.2011 on chemical substances and their mixtures – Dz. Of Laws 2011, No 63, item 322 as amended and Regulation of the Minister of Health of 20.4.2012 on labelling of packaging of dangerous substances and mixtures and certain mixtures – Journal Of Laws 2012, item 445);
(D) a purchase document with the name of the biodegradable oil and the quantity guaranteeing the execution of the work ordered will be presented;
(8) In the event of doubt about the oil used by the Contractor, the contracting authority reserves the right to take samples of the used biodegradable oil purchased from another supplier in the quantities necessary for testing its parameters and to submit them for laboratory testing in order to:
(a) perform biodegradation tests;
(b) checking the parameters contained in the safety data sheet of the dangerous preparation;
(9) the costs of laboratory tests will be covered by:
(a) The contracting authority – if the oil has biodegradability parameters not lower than 89 % according to the IU standard;
(b) The Contractor – if the oil tested has parameters lower than 89 % according to the IU standard;
(10) in the Wolsztyn Forest District, operational routes are carried out in accordance with Order No 6 of the Director of the Regional Directorate for State Forests in Zielona Góra of 17 March 2008 on the rules for making stands available to the network of operational routes in forests within the RDLP administration in Zielona Góra (EI-883-4/07/08). The contractor is required to carry out a break on designated non-disease routes, the characteristics of which are as follows:
(a) every 20 m for CPP, TWP and TWN;
(b) every 40 m for TPP, TPN and compound felling plants;
(11) The Contractor shall carry out suspended (stranded) scraping in the case of S2 and S4 timber and semi-suspended, suspended (restrained) in the case of other sorting groups. Note: moored breaks shall not be permitted;
(12) a detailed breakdown of timber harvesting items is provided in Annex 4 to the ToR;
(13) an estimate of the sorting system in the different groups of operations and the average break distances and the estimated quantities of m³ per break-out zone are set out in Annex 3 to the ToR;
(14) performance of the subject-matter of the contract for harvesting and harvesting must not result in mechanical damage to standing trees of more than 5 % of the number of trees in the area covered by the service:
(a) after-care material after logging and early cleaning and late cleaning shall not be located on forest roads and branch lines;
(b) The Contractor shall be required to clean up the land and the workplace from any type of waste (tank of fuels and oils, bottles, paper, used machinery and tools, etc.) arising from the performance of the service and which originates from the Contractor;
(15) to determine the labour intensity of activities:
(a) a reduction factor of 0,9 has been applied to the fences using leaf pillars (no corrosivity or protection);
(b) 1Accounting factor of 1,2 has been applied due to the need to detonate the poles;
(C) a full cataloguity has been applied to the team-SB as in the case of SN operations;
(16) The parties shall allow changes to the quantitative and material scope of the tasks to be carried out in cases where there are circumstances justifying the cancellation or reduction of the size of the task in question (drying, lack of seed production, windscreens, adverse situation on the timber market, etc.) and the remuneration will be calculated on the basis of the unit costs specified in the tender for the work actually performed, provided that a reduction not exceeding 30 % of the value of the contract does not imply an amendment to the contract. The Contractor shall be informed of any reduction in the tasks to be performed as soon as the Contracting Authority has taken a decision to that effect in the order;
(17) The Contracting Authority reserves the right to change the location of the tasks to be carried out in the following circumstances:
— the existence of breeding and protection needs such as: natural causes (e.g. drought, frost, fire, flooding, forest stands risk from insect pests),
— the need to dispose of dry matter, subversions and scrap,
— other unforeseen events affecting the sustainability of the forest and the continuity of production;
(18) cases where there are circumstances justifying the discontinuation of the treatment at the site. The remuneration will be calculated on the basis of the unit costs mentioned in the tender. Every change will be notified to the Contractor at the time of transmission of the assignment to perform the work;
(19) The contracting authority informs that all the works to be procured include access (accommodation) to the area on which the activities described will be carried out;
(20) The Contractor shall comply strictly with the FSC, PEFC (http://www.fsc.pl, http://www.pefc-polska.pl) Principles, Criteria and Standards for Sustainable Forest Management;
(21) The Contractor shall:
(a) to use adequate personal equipment (working clothing, personal protective equipment) in accordance with OSH rules and applicable industry standards (Labour Code – OJ Journal of Laws 1974, No 24, item 141, as amended, Regulation of the Minister for Labour and Social Policy on general provisions on health and safety at work – Journal Journal of Laws 2003, No 169, item 1650 as amended, Regulation of the Minister for the Environment on health and safety at work when carrying out certain forest management activities – Journal Of Laws 2006, No 161, item 1140);
(b) to have suitably equipped emergency and fire protection measures. (softs, fire extinguishers) and instruct their staff on the basic principles of use and emergency assistance;
(C) Contractor’s staff shall be required to stay in reflective orange vests on the surfaces on which logging work is carried out;
(22) from the start of the execution of the ‘order’, the Contractor shall assume responsibility for all matters relating to health and safety and security until the completion of the work;
(23) on the area on which the Contractor will carry out the work, the freedom of residence of the Contracting Authority’s staff shall be guaranteed and responsibility for health and safety in relation to their person is transferred to them at that time;
(24) The Contractor is obliged to provide the services in accordance with the generally applicable rules and the specific rules in force in the LP LP, with particular reference to the provisions contained in the model contracts in question, which constitute Annex 12 to the ToR;
(25) The Contractor shall comply, inter alia, with:
(a) the forest management rules introduced by Order No 53 of the Director-General of State Forests of 21 November 2011;
(b) the forest protection instruction introduced by Order No 57 of the Director-General of State Forests of 22 November 2011;
(C) instructions on health and safety at work when carrying out basic forest management work – introduced by Order No 36 of the Director-General of State Forests of 20.4.2012;
(D) forest fire protection instructions introduced by Order No 54 of the Director-General of State Forests of 21 November 2011;
(e) the Regulation of the Minister for the Environment of 22.3.2006 on detailed rules for the prevention of forest fires (Journal Of Laws 2006, No 58, item 405 as amended);
(F) Regulation of the Minister for the Interior and Administration of 7.6.2010 on fire protection of buildings, other construction works and land (Journal Journal of Laws No 109, item 719);
(g) the Regulation of the Minister of Labour and Social Policy of 26.9.1997 on general provisions on health and safety at work (codification: OJ Journal of Laws 2003, No 169, item 1650 as amended);
(H) Regulation of the Minister for the Environment of 24.8.2006 on health and safety at work when carrying out certain forest management activities (Journal Of Laws 2006, No 161, item 1141);
(I) the Labour Code of 26.6.1974 (consolidated text: OJ 1998, No 21, item 94 as amended);
(J) the Plant Protection Act of 18.12.2003 (consolidated text: Of Laws 2008, No 133, item 849 as amended);
(K) Regulation of the Minister for the Environment of 9 October 2014 on plant species protection (Journal Journal of Laws 2014, item 1409);
(L) Regulation of the Minister for the Environment of 9 October 2014 on the protection of species of mushrooms (Journal of Journal of Laws 2014, item 1408);
(m) the Regulation of the Minister for the Environment of 6 October 2014 on the protection of animal species (Journal Journal of Laws 2014, item 1348);
(N) Order No 20 of the Director of the Regional Directorate for State Forests in Zielona Góra of 25 November 2010 on the types of work to be carried out by at least 2 persons (hereinafter: EI/B-0151-1/10) – Annex 16 to the ToR;
(o) when performing the forest fire protection service (part/package 14), the Contractor is also required to comply strictly with the Instructions on Safety and Health at Work as an observer on fire towers introduced by Order No 22 of 22 November 2009 on the introduction of job safety instructions and handling instructions (nln-130-1/09) – Annex 5 to the ToR;
(26) the surveillance and extinguishment of forest fires shall be carried out according to the technology specified on the spot by the person authorised by the Contracting Authority and shall include:
(a) access to the site of the incident;
(b) burning with hand-held equipment (silencer, blade, hydronet) consisting of burning, backfilling and water pouring a fire burner;
(C) passive surveillance (fire control);
(D) applicable fire protection rules:
— at the time of fire surveillance, not less than 2 persons shall be exposed;
(e) The Contractor shall be obliged to indicate the names of the forest monitors, who shall forward them to the point of fire;
(F) at least 1 of the surveillance persons must be in contact with the fire station by telephone. Contracting authority – contact telephone is provided by a person authorised by the Contracting Authority;
(g) the termination of surveillance actions is decided by a person authorised by the Contracting Authority;
(26) The Contractor shall:
(a) equipping machinery and tractors with appropriate fuel/oil-absorbing mats and using them at the time of spillage or leakage;
(b) for the use of suitable oil/fuel-absorbing mats during replenishment (situation) in sawscreen, it is permitted to have and use canisters with safe tips to prevent spillage of the oil and fuel mix during the refuelling of the saw;
(27) If several contractors perform work on 1 surface, the Contracting Authority shall instruct the Contractor to appoint a coordinator as referred to in Article 208(1)(2) of the Labour Code Act of 26.6.1974, and the Contractor will accept this commitment without any further conditions. The appointment of a co-ordinator shall also be effective in the absence of a signature appointed by the Contractor on the work order for the work to be carried out;
(28) if work is carried out in the UT-DROGIP activity group – Chlorobutin paint (litres and digits in red, background white) should be used for the painting of directional stones. The expected quantities of areas to be renewed are set out in Annex 15a-l to the ToR.
