1.Detailed description of the subject of the contract can be found in the Tender Document (Part IV SWZ), in the Bill of Quantities in the scope of stage 1 and 2 - available only for reference (Part V SWZ) and in the quotation cost estimate (in the scope of disposal of destruction containing exceeding the permissible limits for the content of polycyclic aromatic hydrocarbons) Part VI SWZ. The contractor must calculate the value of the works on the basis of the attached design documentation, on the basis of the amount of asphalt destruction to be disposed of indicated in the GTC, detailed technical specifications, general terms and conditions of the contract for the execution of construction works. 2.The Contractor is obliged to ensure, at his own expense, safe road and pedestrian traffic conditions in the area of the works covered by the contract, on the basis of a traffic organization project, "for the time of construction" drawn up by and at the expense of the Contractor. The Contractor shall be obliged to update the design of the permanent traffic organisation. The project has been adapted to the needs of all users, including ensuring accessibility for people with disabilities. As a public facility, it does not have accessibility restrictions for all road users, which is required by the regulations in force at the time of drawing up the project documentation regarding the requirements, inter alia, for the technical conditions to be met by roads: Regulation of the Minister of Transport and Maritime Economy on technical conditions to be met by public roads and their location (i.e. OJ 2016. Item 124 as amended) In order to provide facilities for the disabled and the elderly, the following documents have been prepared: at pedestrian crossings, lowering the curbs separating the road from the pavement, on pavements in front of pedestrian crossings and bus bay platforms, the use of warning paving panels and road lighting. The Contractor is obliged to transfer the copyright to the photographic and film documentation referred to in the general terms and conditions of the contract for the execution of construction works. 5.In the case of indicating in the description of the subject of the contract trademarks, patents or origin, source or a specific process that characterizes the product or services provided by a specific contractor, the Contracting Authority allows equivalent solutions. If reference is made in the description of the subject of the contract to standards, European technical assessments, approvals, technical specifications and technical reference systems, the Contracting Authority shall allow solutions equivalent to those described. 7. The contracting authority provides for the award of contracts referred to in Art. 1 point 7 of the Public Procurement Act up to a total value of PLN 200 215 526.81 net. A similar contract shall provide for: - preparatory works, - demolition works, - earthworks, - reinforcement of the ground, - drainage of the road body, - foundations, - surfaces, - finishing works, - traffic safety devices, - street elements, - works in the telecommunications industry, - works in the power industry. - works in the field of rainwater and sanitary sewerage, - works in the field of tank construction, - works in the field of water supply and pipelines, - works in the field of greenery management, - works in the field of traffic organization and BRD - works in the field of vehicle inspection sites The above-mentioned works concern the section on which construction works will be carried out and / or adjacent sections. 8. The Contractor is obliged to have a third party liability insurance policy for damage caused during the performance of the contract in the subject of the contract and to third parties for the entire duration of the contract and for a guarantee amount not lower than PLN 50 000 000.00. 1) The Contractor is obliged to provide a copy of the above-mentioned policy within 7 days from the date of conclusion of the contract. Provided that the continuity of insurance is maintained, the Ordering Party allows the possibility of presenting several policies confirming the possession of third party liability insurance during the term of the contract. 2) The Contractor is obliged to provide the Ordering Party with a copy of the next policy within 7 days from the expiry date of the previous policy. If the Contractor fails to comply with the above, the Contracting Authority shall charge the Contractor contractual penalties in the amount specified in the contract. 3) If the policy is not submitted within 30 days from the date of conclusion of the contract, the Ordering Party will have the right to withdraw from the contract. 9. Deadline for the execution of the contract: 24 months from the date of signing the contract, including: - 21 months from the date of signing the contract – deadline for completion of the works; - up to 24 months from the date of signing the contract - the date of implementation of the subject of the contract. Intermediate dates: The Contractor shall comply with the following intermediate deadlines (milestones) for the execution of the works and the sequence of their execution: I Milestone – execution of works (confirmed by a partial acceptance protocol) with a value of not less than 25% of the gross remuneration for the execution of the entire subject of the contract no later than 9 months from the date of signing the contract. Milestone II - execution of works (confirmed by a partial acceptance protocol) with a value of not less than 60% of the gross remuneration for the performance of the entire subject of the contract no later than 18 months from the date of conclusion of the contract. Milestone III - performance of 100% of works (confirmed by the Ordering Party with a protocol of final acceptance of works without significant defects) within a period not longer than the deadline for final acceptance of works. The contracting authority, in accordance with the terms of the contract, allows the possibility of changing the deadline for the implementation of intermediate deadlines. The Contracting Authority will be entitled to charge contractual penalties in accordance with the contract for non-fulfilment of the intermediate milestone. 10. The contractor whose tender has been selected as the most advantageous shall lodge a performance bond amounting to 5% of the total price quoted in the tender.
