Description
1. The subject of the contract is the supply of 5 units of brand new municipal mini-tractors with equipment for winter maintenance of pavements and bicycle paths and mowing green areas in urban space. 2. Each set includes a mini-tractor and compatible equipment specified in the Description of the Order Item (OPZ-Annex 1 to the SWZ). All components of the set must be complete, unused, free from physical and legal defects, come from serial production and meet the requirements of the procurement documents. 3. A detailed description of the technical, functional, documentation, warranty and acceptance requirements is set out in Annex 1 to the FTZ-OPZ. 4. The Contractor shall provide a guarantee for the entire subject of the contract for a period of not less than 12 months, calculated from the date on which the final acceptance report is signed without reservations. The guarantee period offered shall be assessed in the criterion set out in Part XXI of the FTZ. 5. The mini-tractor and the equipment included in the set shall be mutually compatible and capable of safe operation in all configurations provided for in the OIP. All 5 complete sets must be delivered at the same time, unless the Ordering Party gives prior written consent for partial deliveries. 6. At the latest upon receipt, the Contractor shall provide for each mini-tractor a certificate of conformity (CoC) or other approval documents required for the registration and entry into service of the vehicle in the territory of the Republic of Poland. For interchangeable equipment, the Contractor shall provide the CE marking, the declaration of conformity relevant for the date of placing on the market, and the instructions for use and safety in Polish, provided that the obligation to draw them up arises from the provisions applicable to the product concerned. 7. During the warranty period, the contractor will provide service of the offered mini-tractors and equipment, performed by a service authorized to carry out warranty repairs of the product. Own service, manufacturer, authorized partner or subcontractor, for whose actions and omissions the Contractor is responsible, is allowed. 8. The Contractor shall ensure that diagnostics or maintenance at the place of use of the equipment begin no later than 48 hours on working days after the failure has been effectively reported. 9. The Contractor confirms on the basis of the guarantee and service declaration forming part of the tender (according to the model annexed to the FTZ) acceptance of the obligations regarding the warranty and service of tractors with equipment.
