Germany-Düsseldorf: Pharmaceutical products

The subject of this publication is the conclusion of agreements under Paragraph 130a(8) of the SGB V for the active substance glatiramer acetate in the context of an ‘open house procedure’. Subject to uniform contractual conditions and a uniform access procedure, all appropriate and interested pharmaceutical undertakings or groups of pharmaceutical undertakings shall be offered the right to conclude or accede to a discount agreement pursuant to Paragraph 130a(8) of the SGB V for those active ingredients.
In addition, other open-house contracts have been offered in the past, which are included in the list of active substances on the website.

To this end, interested pharmaceutical companies can find the participation documents on the website:

after registration. In order to conclude a contract, the interested pharmaceutical company must submit the requested participation documents in full and signed. A contract will be concluded with each pharmaceutical company that fulfils the eligibility criteria. There is no exclusivity. Accession or conclusion of the contract may take place at any time and under the same conditions. Individual contractual negotiations are not carried out.
The earliest contract start date is 1.5.2015. On this basis, the maximum duration of the contract is 21 months. Should AOK Rheinland/Hamburg launch an invitation to tender for exclusive contracts in the form of an open procedure during the contract period, the contracts concluded in the context of this publication will be terminated in accordance with the contractual provisions.
This publication does not constitute the award of a public contract within the meaning of the Procurement Coordination Directive (Directive 2004/18/EC of the European Parliament and of the Council) or public procurement law. In order to ensure the highest degree of transparency for the envisaged contracts, the publication will be made in the Supplement to the Official Journal of the European Union. In the absence of a corresponding publication form, the contract notice will be used.
The resulting conceptual requirements, such as the procedural title ‘open procedure’, are solely due to the use of this notice form and the publication platform. There is no other significance, in particular a submission to public procurement rules, to the extent that they are not legally obliged to do so.
