1. The subject of the contract is the execution by the Contractor, delivery to the Ordering Party of a new heavy rescue and firefighting car with equipment. 2. The subject-matter of the contract must meet the requirements resulting from the applicable provisions, standards, as well as the requirements of the Contracting Authority specified in Annex 1 to the SWZ – Description of the subject-matter of the contract and in the model contract constituting Annex 8 to the SWZ. 3. These proceedings are conducted under an open tender procedure pursuant to the Public Procurement Law Act of 11 September 2019 (Journal of Laws 2019, item Journal of Laws 2023, item 1605, as amended) hereinafter referred to as the "PPL Act" and these Terms and Conditions Specifications, hereinafter referred to as the "SWZ". 4. The estimated value of the contract exceeds the amount specified in the notice of the President of the Public Procurement Office issued pursuant to Art. 2 of the PPL Act. 5. The contracting authority provides for the application of the so-called reverse procedure referred to in Art. 1 of the PPL Act, i.e. The Contracting Authority will first examine and evaluate the tenders and then select the Contractor whose tender has received the highest score in terms of the lack of grounds for exclusion and fulfilment of the conditions for participation in the procedure. 6. Pursuant to Article 257(1) of the Public Procurement Act, the Contracting Authority provides for the possibility of cancelling the procedure in question if the public funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been awarded to it.
