Conclusion of an agreement to lift the Danish Building and Property Agency’s obligation to tender for tailor-made building and construction works on leases (power of attorney model)
The Danish Building and Property Agency will rent from CPH City & Port Development a property on which tailor-made construction works are to be carried out, which are covered by Title II of the Public Procurement Act, cf. Section 24(24) of the Public Procurement Act. According to the so-called proxy model, the Danish Building and Property Agency has the opportunity to entrust another actor, as a proxy, to lift the Danish Building and Property Agency's obligation to tender for the tailor-made construction works. The Danish Building and Property Agency will therefore enter into an agreement with CPH City & Port Development, which obliges CPH City & Port Development to ensure that the works are offered in accordance with the rules of the Public Procurement Act. CPH City & Port Development is itself a public contracting authority, which is obliged to follow the procurement rules. The Danish Building and Property Agency has assessed that such an agreement is not in itself covered by the Public Procurement Act, which is why the agreement is concluded without a prior call for tenders.The value of the contract is calculated on the basis of a 30-year commitment period of the commercial lease with an annual cost of rent and operation of DKK 122 million.
