1. The contract concerns:
(a) physical protection of persons and property
b) monitoring of intrusion and seizure signalling systems
(C) maintenance of intrusion signalling systems, access control systems
(D) maintenance of CCTV surveillance systems
(e) installing transmitters for remote monitoring of the intrusion and seizure signalling system divided into 5 (five) parts in the territorial scope.
2. A detailed description of the subject-matter of the contract is set out in the annexes to the Specifications of the Relevant Conditions of the Contract, hereinafter referred to as ‘the SCI’, i.e.: in Annex 2a – ‘General description of the subject-matter of the contract’, Annex 2b – ‘Detailed description of the subject-matter of the contract’ and in Annex 2c – ‘Summary of accessions to the contract’.
3. The Contractor will take over the obligations to protect persons and property on the day preceding the start of the provision of the services (in accordance with the list of accessions by the Units to the contract set out in Annex 2c to the ToR) during the CAB’s working hours indicated in point 6 of the Detailed description of the subject-matter of the contract.
4. The tasks relating to the installation of remote monitoring and monitoring of intrusion and seizure signalling systems will be taken over the 10 working days preceding the provision of the services (in accordance with the list of accessions of the units to the contract set out in Annex 2c to the ToR) during the CAB’s operating hours indicated in point 6 of the detailed description of the subject-matter of the contract.
5. The obligations will be expressed on the last day of the contract during the CAB’s working hours indicated in point 6 of the Detailed description of the subject-matter of the contract.
6. None of the Contracting Authority’s premises listed in Annex 2b – ‘Detailed description of the subject-matter of the contract’ is a mandatory protected object within the meaning of Article 5 of the Act of 22 August 1997 on the protection of persons and property (consolidated text: OJ Of Laws 2014, item 1099).
7. The contracting authority reserves the right to restrict the subject-matter of the contract (not to perform security tasks in the facility) in the event of cessation of the use of the facility (e.g. permanent management to property, transfer of the site to another entity). The Contractor will not make any claim against the Contracting Authority on this basis.
8. The contracting authority provides for the award of complementary contracts with a total value of up to 20 % of the value of the basic contract. Complementary contracts will consist of repeating the same type of contracts as the main contract. Supplementary contracts may be awarded in the case of, for example, a change in the location of the Unit, the acquisition of real estate to the CAB’s premises, an increase in the number of the CAB’s premises, within 3 years of the award of the primary contract, under a separate contract, or separate contracts, pursuant to Article 67(1). 1(6) of the Act.
9. Under the option right referred to in Article 34. 5 The Contracting Act allows the contract to be increased by a maximum of 10 % of the value of the basic contract if additional ongoing protection, monitoring, maintenance or installation of radio transmitters must be ensured, at unit prices resulting from the ‘Summary of the costs of performing the subject of the contract’ set out in Annex 13 to the tender.
10. The contracting authority recommends that, before submitting a tender, the Contractors carry out an on-site inspection and take careful note of the sites and facilities indicated in the ‘List of units for which the procedure is being conducted’, set out in Annex 1 to the ToR, after prior agreement has been reached with the persons indicated therein.
