Description

The subject of this contract is the purchase of 10 ambulances and medical equipment for ZRM equipment. A detailed description of the subject-matter of the contract is set out in Annex 2 to the FTZ. The subject-matter of the contract free from physical and legal defects, brand new, not previously used by third parties, in particular, did not serve as an object used for demonstration purposes and is of good quality. It has also not been reconditioned before. The offered medical devices covered by the subject-matter of the contract must meet the requirements set out in the Medical Devices Act of 7 April 2022 (Journal of Laws 2022, No. Journal of Laws 2024, item 1620). Labelling of supplied materials, instructions for use, product descriptions must be drawn up in Polish. The Contractor undertakes to perform the subject of the contract in accordance with all the requirements of the Ordering Party indicated in the FTZ. The Contractor shall submit a tender for the whole of the lot(s) of his choice, taking into account all the items of the lot concerned. All requirements set out in the procurement documents are minimum requirements and their fulfilment is mandatory. Failure to meet the above-mentioned minimum requirements will result in the rejection of the tender as non-compliant with the terms of the contract on the basis of Art. 1 point 5 of the PPL Act. If the Customer indicates in the description of the subject of the contract trademarks, patents or origins, sources or a specific process that characterizes the products or services provided by a particular Contractor, it is allowed to offer solutions equivalent to those described, provided that they maintain the same minimum technical, quality and functional parameters. Where reference is made in the description of the subject-matter of the contract to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and paragraph. 3 of the Public Procurement Act, the Employer allows solutions equivalent to those described. The Contractor who invokes equivalent solutions is obliged to demonstrate that the solution offered by him meets the requirements specified by the Ordering Party.
