308670-2024 Page 2/26 2.1.1. prepared by the company: PRO-AMAR Pracownia Projektowa Sp. z o.o. – construction and executive project. 13/ The detailed description of the contract includes design documentation consisting of the following parts: a/ Technical - implementing projects: industry – architecture industry – construction, industry – indoor plumbing, industry – indoor plumbing, industry – ventilation, industry – electrical and teletechnical industry – land use, industry – road industry – traffic organisation, industry – greenery, industry – outdoor plumbing, industry – outdoor lighting, teletechnical sewerage, industry monitoring – networks and connections – plumbing geological and engineering documentation b/ Technical specifications for the execution and acceptance of works – in all industries; c/ Measurements of works. 14/ The Contractor shall use construction products for the execution of the subject of the Contract, which are admitted to the market and commonly used in construction, in accordance with: Article 10 of the Construction Law Act of 7 July 1994 (i.e. Journal of Laws 2023, item 682). The Ordering Party only accepts construction materials in the 1st class of quality. 15/ The Contractor will comply with the environmental protection requirements set out in Annex 25 to the EWC ‘Information on the manner in which construction works are carried out, the use of construction products and the preparation of documentation confirming that the project does not cause significant damage to environmental objectives’ and in Annex 26 to the EWC ‘Instructions for the protection of greenery during the investment process’ 2. Requirements for variants: 1/ The variant offer must be related to the subject of the contract and must not change the nature and purpose of the buildings, 2/ Prefabricated reinforced concrete technology is allowed in the construction of buildings – load-bearing elements (without partition walls in apartments, which should be bricked in order to freely arrange the interior of the apartment); 3/ Other elements of the contract must be performed in accordance with the documentation and guidelines referred to in paragraph. 1 and other content of the SWZ; 4/ All costs related to the development of replacement documentation in the field of construction technology and other necessary costs related thereto, including the preparation of additional documentation, obtaining the consent of the Chief Designer and other opinions required by law, with the change of the construction permit shall be borne by the Contractor; 5/ If necessary, the Contractor shall request the relevant public administration bodies to issue the conditions necessary for the design and obtain the necessary arrangements. 6/ The Contractor will transfer to the Ordering Party proprietary copyrights to the studies subject to the contract and the right to all copies of these studies, i.e. the right to use and dispose of the studies in all fields of exploitation specified in Article 50 of the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws of 2022, item 2509) unlimited in time and place, including in particular: a) to use and consolidate the design study for their own use, including in particular the transfer of the design study or any part thereof, including copies thereof: other economic operators as a basis or starting material for the performance of other design studies, economic operators participating in a public procurement procedure, as part of the tender specifications, other economic operators as a basis for the performance or supervision of works, third parties involved in the investment process Text automatically translated in your browsing language Automatically translated
