Each Contractor must attach to the tender the means of proof in question, which are to confirm that the subject-matter of the contract offered corresponds to the requirements specified by the Contracting Authority: 1) Declaration of conformity and/or CE certificate (depending on the class of medical device) and relevant statements (if required) in accordance with Regulation 2017/745 on medical devices (MDR) or Council Directive 93/42/EEC (MDD) with subsequent transitional provisions. Having regard to Article 107(1) of the Treaty on the Functioning of the European Union, 2 of the Act of the Public Procurement Office, the Contracting Authority informs that the means of proof referred to in point 1) are to be supplemented. 9. Information on joint bids by contractors is provided in Chapter IX of the SWZ. 10. The Contracting Authority provides for the possibility of changing the provisions of the concluded agreement (so-called contractual changes based on Art. 1 point 1 of the Public Procurement Act) in relation to the content of the tender on the basis of which the Contractor was selected, in accordance with the conditions set out in Annex 4 to the SWZ. Any agreement may also be amended in the cases referred to in Art. 1 points 2-4 and par. 2 of the PPL Act. 11. An information clause resulting from Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, was included by the Ordering Party in the SWZ. 12.
