Description

1. The subject of the contract is: Purchase, delivery and assembly of equipment for the Power Grid Assembly Studio for the needs of the emerging Industry Skills Centre in the field of Energy in Nisko as part of the project: ‘Establishment and operation of the Nizhny Novgorod Energy Sector Skills Centre’, financed under the National Recovery and Resilience Plan (NRRP). 2. The contracting authority provides for the possibility of cancelling the procurement procedure under Article 257 of the Public Procurement Act if the public funds that the contracting authority intended to allocate to finance all or part of the contract are not awarded to it. 3. The order is divided into four parts. The contracting authority shall allow partial tenders to be submitted. The Contracting Authority shall not limit the number of lots for which the Contractor may submit a tender: 1) Part 1: Purchase of delivery including assembly of tools and equipment – the description of the subject of the contract is attached as Annex 8 to Part 1 of the SWZ 2) Part 2: Security relay tester – the description of the subject of the contract is attached as Annex 8 to Part 2 of the SWZ 3) Part 3: Purchase of delivery with assembly - Protection automation of MV switchgear - description of the subject of the contract is attached as Annex 8 for part 3 to the SWZ 4) Part 4: Execution and assembly of cells – the description of the subject of the contract is attached as Annex 8 to Part 4 of the SWZ 4. It is the contractor's responsibility to demonstrate that the offered supplies meet the requirements of the Ordering Party. 5. All products from specific manufacturers define the minimum quality parameters and performance characteristics that products must meet in order to meet the requirements set by the Ordering Party and constitute only the quality standard of the subject of the contract. 6. By the provision regarding the minimum requirements of quality parameters, the Ordering Party understands the requirements of goods contained in generally available sources, catalogs, websites of manufacturers. Using exemplary manufacturer names is only aimed at clarifying the level of expectations of the Ordering Party in relation to a specific solution. Thus, the use of names of producers or products is purely illustrative. The contracting authority, when describing the subject of the contract, indicating the designation of a specific producer (supplier) or a specific product, allows at the same time equivalent products with quality parameters and performance characteristics, at least at the level of the parameters of the indicated product, thus recognising any product with the indicated parameters or better. In such a situation, the Ordering Party requires the submission of relevant documents authenticating these materials or devices. 7. For specified devices, the given parameters are minimum values, each equipment with better parameters, higher than the specified ones meets the requirements specified by the Ordering Party. All devices should meet all regulations regarding the right to be allowed to use in Poland and have appropriate documents proving that they meet all the necessary standards and guidelines that the above-mentioned equipment should meet before it is allowed to use. 8. Whenever materials, equipment, computer programs, etc. are referred to in this TMS (in the description of the subject-matter of the contract) with an indication of the trade marks, patents or origin, source or specific process which characterises the products or services provided by a particular economic operator, such indications shall be deemed to be accompanied by the words ‘or equivalent’. The designations and proper names of products are only used to describe the minimum technical parameters that these products should meet. The criteria for assessing equivalence referred to in Article 99(6) of the Public Procurement Act are set out in the description of the subject-matter of the contract. 9. The equipment that is the subject of the contract must be brand new, of good quality, efficient, free from physical defects, as well as from any legal defects and claims of third parties, not used, not post-exhibition. By the term brand new Customer understands products made of new elements, without any trace of damage, in the original packaging of the manufacturer, e.g. with a visible logo, product symbol. 10. Delivery to the indicated place includes bringing, assembly, installation (connection) and all other costs related to the performance of the subject of the contract in accordance with the requirements set by the Ordering Party. 11. The minimum guarantee period for the subject-matter of the contract shall be set at: 24 months, counting from the date of receipt of the subject of the order.
