Description

1) The subject of the contract includes the delivery of a medium rescue and firefighting car with a 4x4 drive for TSO Boruszowice. 2) The subject of the contract, including the conditions for the performance of the contract, shall specify in detail: a) Technical form; b) Draft provisions of the agreement. (3) If the procurement documents indicate trademarks, patents, origin, sources or specific processes characterising products, materials, solutions or services provided by a specific contractor, manufacturer, or standards and other references referred to in Art. 1 point 2 or paragraph. 3 of the Act, they should be treated as examples, while the Ordering Party allows offering materials or equivalent solutions. Materials, devices or solutions with parameters not inferior to those required shall be considered equivalent and, if the minimum parameters are not specified, shall be understood as materials, devices or solutions with similar parameters suitable for the desired use, including in terms of the identity of the function, the type and quality of the materials and the technical data. 4) The Ordering Party does not allow the possibility of submitting partial tenders. 5) The Ordering Party does not allow the submission of variant offers. 6) The Contractor may entrust the performance of part of the contract to a subcontractor. (7) Pursuant to Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine, it is prohibited to perform a public contract with subcontractors, suppliers or entities whose capacities are relied on within the meaning of Directive 2014/24/EU where they account for more than 10% of the value of the contract. 8) The Ordering Party does not reserve the obligation to personally perform key tasks by the Contractor.
