Please refer to the explanations given in point VI.3).
The purpose of this notice is to conclude agreements on medicinal products with pharmaceutical companies within the meaning of the first sentence of Paragraph 130a(8) of Book V of the Social Code (SGBV) (discount agreements). In accordance with the first sentence of Paragraph 130a(8) of the SGB V, the invitation to participate is addressed only to pharmaceutical companies or consortia of pharmaceutical contractors within the meaning of Paragraph 4(18) of the Arzneimittelgesetz (Law on medicinal products, hereinafter ‘AMG’). This is not an open procedure under the first sentence of Paragraph 3(1) of the VOL/A. The corresponding indication in point IV.1.1) is only due to the scheme of this publication form. The publication serves as an invitation to conclude/enrol in discount contracts with non-negotiable terms set for all participants, including the amount of the rebate. Contracting parties may become unlimited many pharmaceutical undertakings or consortia of pharmaceutical contractors within the meaning of Section 4(18) of the Arzneimittelgesetz (Medicinal Products Act, ‘AMG’). The information in point II.1.4) is also due to the scheme of this publication form. The contract or accession takes place, in which the required self-declarations and annexes (see point III.2.1) and the contract(s) are sent to the CAB. More specifically, there is the possibility of contracts for the active substances/combinations of active substances listed in Annex B.
The earliest start date is 1.5.2014, provided that the signed contract and the required declarations or evidence have been received by the CAB no later than 5.4.2014. On subsequent receipt, the start of the contract shall be the first of the month following the month of receipt of the signed contract and the required declarations or evidence by the CAB, provided that it is received by the CAB by the 5th of each month; otherwise, the first of the next month. It should be noted that the time limit referred to in point IV.3.4) of the notice is due to the structure of the notice.
The contracts shall be terminated automatically without the need to terminate the contract once the active substance(s) or combination(s) of the active substance(s) have been identified by means of a formal procurement procedure. In any case, the contracts will end on 30.4.2016.
