This contract notice initiates a Dynamic Public Procurement System (hereinafter referred to as -SAD) to enable the purchase of spare parts and repair and maintenance services for Mercedes unimog multifunctional cars, Caterpillar backhoe loaders and DRDP CLUJ cars and vans for a period of 2 years, with the possibility of extension, if the estimated value/allocated funds have not been fully used. The CA intends to award individual contracts through the SAD according to the needs of the DRDP CLUJ. The contracts that will be awarded by running the SAD can be concluded as follows: either a supply or service contract and/or mixed contract, combining the supply of products and services into a single contract, determined on the basis of the main purpose of the contract. The award procedure will comply with the rules of the restricted tender, to be carried out in 2 stages: • Step1: Submission of requests to participate and selection of candidates, applying the qualification and selection criteria, • Step2: Submission of bids in SAD by candidates selected under the first stage. Given the open nature of the SAD, after the launch of the SAD and throughout its valab.a, an ec. op. may join at any time of the validity of the SAD if it fulfils the criteria specified in the contract notice. SAD is grouped into 4 categories (lots) of products and services, detailed in the specifications. The estimated value is the estimated maximum value of RON 4 493 012.59 excluding VAT of all the contracts envisaged for each total application of the SAD. •Lot 1 Multifunctional machines Mercedes- Unimog U1200, U1400 - Estimated value of lot no.1 = 717.842,57 lei without VAT •Lot 2- Multifunctional machines Mercedes- Unimog U423 - Estimated value of lot no.2 = 1.067.897,18 lei without VAT •Lot 3- Caterpillar backhoe machinery - Estimated value of lot no.3 = 720.119,63 lei without VAT •Lot 4 Cars and vans - Estimated value of lot no.4 = 1.987.153,21 lei without VAT. The contract modif. limits will be in accordance with Law 98/2016, and will comply with the site provided for in Article 221 of Law 98/2016. The CA reserves the right to amend the contract in accordance with Article 221 of Leg.98/2016, provided that such amendment does not fall within the provisions of Article 221(7) of Leg.98/2016, i.e. it does not represent a substantial amendment. CALLING FOR CLARIFICATIONS / ANSWERS TO CLARIFICATION APPLICATIONS A. In accordance with Article 160(1) of Law No 98/2016, the term. the limit up to which any ec. op. interested in participating in the achiz.pub. procedure has the right to request clarifications or additional information. in relation to DA is 18 days before the term.the limit for submitting tenders. B. In accordance with Article 160(2) of Law No 98/2016, the CA shall establish a single term in which it shall respond clearly and completely to all requests for clarification/supplementary information on the 11th day before the term set for the submission of tenders. *Any request for clarification submitted after the date mentioned in point A) will make it impossible for the CA to provide a reply within the deadline mentioned in point B) and as a result any request for clarification within the deadline mentioned will be considered late. REQUEST FOR CLARIFICATIONS / REPLY TO CLARIFICATIONS -ETAPA II The minimum time limit for receipt of tenders shall be at least 10 days from the date on which the invitation to tender is sent. - Term.lim. until which any interested ec. op. have the right to request clarif. or inform.suplim. regarding the content of the information in the Inv. of participation. is max. 5 days before the deadline for submission of tenders.
