The subject of this invitation to tender (EU-wide open procedure) is the conclusion of ‘agreements in accordance with Paragraph 130a(8) of the SGB V’ (hereinafter: Discount contracts or individually) for the 12-month period from 1 March 2015 to 29 February 2016, with two six-month extension options for the active substance combination ‘Brinzolamide/Timolol’. In accordance with the first sentence of Paragraph 130a(8) of the SGB V, the invitation to tender is addressed only to pharmaceutical undertakings (or consortia of pharmaceutical undertakings) within the meaning of Paragraph 4(18) of the AMG.
The contract will be awarded in two territorial lots, each with two specialists. For each territorial/specialised combination, a framework agreement is concluded with an economic operator.
Procurement needs do not include medicinal products which are prescribed and billed for as part of consultation hours. The same applies to finished medicinal products in so far as they are processed and charged in preparations in pharmacies prior to supply to the consumer. Nor do procurement requirements include pharmaceuticals supplied by way of reimbursement. The same applies to medicinal products supplied by hospital pharmacies to AOK-insured persons on the basis of agreements pursuant to § 129a SGB V and charged to the AOKs.
