Description

Article 94 of the TRLA designates the Water Commissariats in the field of intercommunal basins as those responsible for the functions of inspection and control of the public water domain, inspection and surveillance of the conditions and works relating to concessions and authorizations in DPH and, in general, the application of water and channel police regulations, and in this framework, these units have carried out over time numerous actions of improvements and recovery of channel capacity, in which a multitude of actions are executed, aimed at maintaining the natural drainage capacity of the channels. With regard to the protection of the public water domain, points 1 and 4 of Article 28 of Law 10/2001 of 5 July 2001 on the National Hydrological Plan (hereinafter LPHN) state as follows: “1. In the public hydraulic domain, the necessary measures will be taken to correct the situations that affect its protection, including the elimination of constructions and other facilities located in it. 4. The actions in public channels located in urban areas will correspond to the competent administrations in matters of spatial planning and urban planning, without prejudice to the competences of the Hydraulic Administration over the public hydraulic domain. The Ministry of the Environment and the Autonomous and Local Administrations may sign agreements for the financing of these actions.” The Segura O.A.
