TECHNICAL OPENING ASSISTANCE FOR THE CONDUCT OF OPERATION AND THE COMMISSION ON THE DESIGN AND CONSTRUCTION OF SEMI-LIBERTE PENITTENTIAL BATIMENTS
This framework agreement is part of the deployment of an innovative real estate programme to respond to the rapid implementation of the capacity of detained persons benefiting from a semi-freedom regime. The type of contract chosen to respond to it is one (or more) public innovation partnership contract(s) aimed at researching and developing one (or more) project(s) of modular and standardised semi-freedom prison buildings - QSL - and then constructing these buildings. The consultation on the latter is ongoing, in accordance with Articles L 2172-3, R 2172-20 to R 2172-32 of the Code of Public Order. The purpose of the partnership is to designate a maximum of three partners and to conclude separate innovation partnership contracts with them. The Innovation Partnership with each partner consists of two phases: - Phase 1: research and development services, including prototyping. Phase 1 has an indicative provisional duration of five (5) months; - Phase 2: framework agreement for the design, manufacture and construction of a maximum of 1500 semi-freedom quarters in France, for a period of forty-eight (48) months, renewable three (3) times for a period of twelve (12) months pursuant to Article L. 2125-1 of the Public Procurement Code and in so far as this contract requires investments to be amortised over a significant period of time. The attention of the holder is drawn to the simultaneous conduct of the realization phase with the simultaneous follow-up of several QSL. This consultation was conducted following a formalised open tender procedure, in accordance with the provisions of Articles L2124-1 and L2124-2 and R2161-2 to R2161-5 of the Public Procurement Code. The subject of this framework agreement is a set of services contributing to the technical assistance of the contracting authority for the conduct of operations and commissioning relating to the design and construction of semi-liberty prison buildings in France via one or more innovation partnerships. The holders of this framework agreement, referred to as the "technical assistant, operation manager" or "ATMO", shall ensure, during the execution of the studies and works, compliance with the contractual and regulatory documents and shall report to the contracting authority. He will also act as commission agent. The framework agreement includes a lump sum share for phase 1 of research and development. The so-called acquisition phase 2 is at unit prices. This consultation does not accept any options or variants. In order to ensure compliance with the competition rules, candidates must: • may not present themselves as an authorised representative of more than one group • may not present themselves as an authorised representative of a group and as a member of one or more other groups. In the case of a grouping, the successful grouping will be a joint and several grouping or a joint grouping with a joint and several representative. There are no slices planned. This framework agreement is allotted in 3 separate lots. Each lot corresponds to assistance in monitoring and steering an innovation partnership:. Lot 1: Technical assistance for project management for the conduct of operations and commissioning relating to the design and construction of semi-freedom penitentiary buildings for the innovation partnership contract notified in 1 (No 1) Lot 2: Technical assistance for project management for the conduct of operations and commissioning relating to the design and construction of semi-freedom penitentiary buildings for the innovation partnership contract notified in 2nd (No 2) Lot 3: Technical assistance for project management for the conduct of operations and commissioning relating to the design and construction of semi-freedom penitentiary buildings for the innovation partnership contract notified in 3rd (n°3) The candidate declared to be the successful tenderer for one lot may not be designated as the successful tenderer for the other lots. The award conditions are detailed in Article 7 of the Consultation Regulation. For each lot, the share of purchase orders and subsequent contracts is fixed without a minimum amount and with a maximum amount set at HT 3 000 000 for the total duration of the framework agreement.
